No, I have not implied behavior like this is normal actually, I am arguing the key point here, that what he did was legal. People here are saying "oh, but it's so sick, he's so old and nasty, I can't believe he got away with this travesty!". I'm trying to explain why it was perfectly legal, and why people are over reacting emotionally, and the repercussions of punishing thoughts and fantasies on this level. It may be a disturbing thought for most people here, but I must stress the ultimate consequences of letting our emotions take over here.
Again, you move the goal posts. You HAVE implied it is normal, and NO ONE has said thoughts should be illegal.

Depends on the 40 year old and the 13 year old. There is no guarantee a 40 year old "knows what he's doing" any more than there is a 13 year old "who doesnt know what he's doing."
Lust is a base urge. Very little thought is given when anyone is satisfying base urges. Just look at all the STD's and unwanted pregnancies.

Thoughts are thoughts. It's not illegal, and it's not morally wrong. Is it normal? That's up to you to decide. I am saying this man has the LEGAL RIGHT to masturbate over FAKE pictures or fantasies if he wants to. The option is there, and some people are going to use it. I have made it more than clear why we can't punish this type of thing.
No one said it should be illegal. the statement you are defending was that it is not morally wrong for a 40 year old man to masturbate while thinking of a 13 year old girl.
