No, I have not implied behavior like this is normal actually, I am arguing the key point here, that what he did was legal. People here are saying "oh, but it's so sick, he's so old and nasty, I can't believe he got away with this travesty!". I'm trying to explain why it was perfectly legal, and why people are over reacting emotionally, and the repercussions of punishing thoughts and fantasies on this level. It may be a disturbing thought for most people here, but I must stress the ultimate consequences of letting our emotions take over here.

Would you feel the same way if it was some teen student lusting after her fit and hip 40 year old teacher?

Any action would certainly be wrong because of many reasons, a position of power not being the least, but would you still view this girl as a horrible monster who has no business visiting her sick fantasy?

I'm going to explain this as best as I can in simple terms. Lets say I photo-shopped a car running over, and killing, a bunch of children (as suggested by a post a few pages back). Should I be charged for murder? Were any kids actually harmed, was there a victim(s)? Should the picture be destroyed, and why? Now compare the two scenarios, between MURDER and CHILD ABUSE. Like I said earlier, if you enjoy virtually killing people in a video game, does that not make you a sick and disturbed psychopath with a tendency for violence and blood lust? Is it "normal" to enjoy those video games? All sorts of philosophical questions must be examined here.

No. What you are saying is that 40 year old adult man should be held to the same emotional standard as a 13 year old girl. I find that a ridiculous comparison.It is morally WRONG for a 40 year old man to entertain (not passing) thoughts about a 13 year old girl because he is an ADULT and she is a CHILD, clearly.

Depends on the 40 year old and the 13 year old. There is no guarantee a 40 year old "knows what he's doing" any more than there is a 13 year old "who doesnt know what he's doing."

Officers who searched Gerber's home did not find photos of his daughter in her underwear, but saw pictures of her head superimposed on seven pornographic photos of women's bodies on a computer drive, the court said.

So he was actually trying to get his 13 year old daughter to pose for photos.... he was plying her with drugs also, I'm sure this was only heading in one direction.

The guy is sick and deserves to be locked up.

The reason you see children of 12 being tried as adults is because America is rapidly becoming an Idiocracy full of blood thristy morons who want children treated like adults for their own sick reasons, certainly not because the science justifies it, or the law requires it. We are overturning good law and precedent TO punish children as adults to satisfy these morons.

Thoughts are thoughts. It's not illegal, and it's not morally wrong. Is it normal? That's up to you to decide. I am saying this man has the LEGAL RIGHT to masturbate over FAKE pictures or fantasies if he wants to. The option is there, and some people are going to use it. I have made it more than clear why we can't punish this type of thing.
