Again, you move the goal posts. You HAVE implied it is normal, and NO ONE has said thoughts should be illegal.
No, I have not implied behavior like this is normal actually, I am arguing the key point here, that what he did was legal. People here are saying "oh, but it's so sick, he's so old and nasty, I can't believe he got away with this travesty!". I'm trying to explain why it was perfectly legal, and why people are over reacting emotionally, and the repercussions of punishing thoughts and fantasies on this level. It may be a disturbing thought for most people here, but I must stress the ultimate consequences of letting our emotions take over here.

Most people are totally ignoring these facts, that were bought up more than once in this thread:

During their visits over the next few months, the girl said, Gerber gave her marijuana, which she had used before, and coc aine, which she wanted to try. During one of the drug sessions, she said, Gerber asked her to pose for pictures and she agreed, but she burst into tears when he told her to strip to her underwear.

And that is why I am wonder that the Division of youth and family services were not investigating prior to the act of the photoshopping, they certainly get involved in a lot of investigations on a lot less, can anybody here say heresay. That's what it is when an "anonymous" report is made, heresay, when a report is made by the minor though, then it's ignored? WTH?

Our system is a joke all around!!!!

now this is actually against man's law and can be
prosecuted. If the man tried to coerce this 14 yr old
into posing naked, then yes he ought to be tried
in court on these charges. He actually put his
thoughts into actions which directly involved
the 14 yr old.

See, I did not defend him on his
direct actions involving the 14 yr old

Lust is lust.

Would you feel the same way if it was some teen student lusting after her fit and hip 40 year old teacher?

Any action would certainly be wrong because of many reasons, a position of power not being the least, but would you still view this girl as a horrible monster who has no business visiting her sick fantasy?

You should read the justifications for such conscious, extended sexual fantasies by some in this thread:

By the same logic, an 80 year old man may not entertain sexual fantasies about a pretty 25 year old girl?

When a girl has secondary sexual traits developed enough, it is normal to be attracted to her. Period.

I'm going to explain this as best as I can in simple terms. Lets say I photo-shopped a car running over, and killing, a bunch of children (as suggested by a post a few pages back). Should I be charged for murder? Were any kids actually harmed, was there a victim(s)? Should the picture be destroyed, and why? Now compare the two scenarios, between MURDER and CHILD ABUSE. Like I said earlier, if you enjoy virtually killing people in a video game, does that not make you a sick and disturbed psychopath with a tendency for violence and blood lust? Is it "normal" to enjoy those video games? All sorts of philosophical questions must be examined here.

No. What you are saying is that 40 year old adult man should be held to the same emotional standard as a 13 year old girl. I find that a ridiculous comparison. It is morally WRONG for a 40 year old man to entertain (not passing) thoughts about a 13 year old girl because he is an ADULT and she is a CHILD, clearly.

So you're drawing arbitrary lines and labeling one side "evil" and another "naive."

Is that it?

Amazing, we're all just stupid or evil.

I know, its highly disturbing i can't understand why anyone would think its normal for their own father to do this, let alone, countries where parents allow their 12 yr old daughters to be married (as if that makes it ok) and then groped by sexual perverts just because they have money to buy them. Its wrong and inhumane.

Im sorry, but I call bullsnip.

Whacking off to just "any" 13 year old girls face superimposed on an adults naked body is absolutely not the same offense as whacking off to your 13 year old DAUGHTERS face superimposed on an adults naked body.

Sorry. Its not just about the age issue, its about the fact that he is, in essence, fantasizing about sex with his daughter.

No one said it should be illegal. the statement you are defending was that it is not morally wrong for a 40 year old man to masturbate while thinking of a 13 year old girl.

many find that exceedingly disturbing. apparently you dont.

No but you're not reading the entire article, still ignoring some very real infringement he made on his daughter.
However replace the children in your scenario with black people, and YOU better BELIEVE there'd be all kinds of S# raised about it!!!

No offense, but that's a rather daft way of looking at things. An adult knows what he's doing. A horny teen not much older then his peers is totally different.

no offense taken

I just disagree with you.

A sin is a sin no matter what the age.
Once you reach the age of carnal knowledge
a 15 yr old sins just like a 40 yr old.
Knowing right from wrong mentally
is the key.

A crime is a crime no matter the age
which is why you see 12 yr olds being
tried in court as adults when facing murder
charges.

You think the difference between a 40 year old adult man and a 13 year old girl are 'arbitrary'?

Depends on the 40 year old and the 13 year old. There is no guarantee a 40 year old "knows what he's doing" any more than there is a 13 year old "who doesnt know what he's doing."

Lust is a base urge. Very little thought is given when anyone is satisfying base urges. Just look at all the STD's and unwanted pregnancies.

I guess those people are "evil" too because they "should have known better"?

So after reading the article I realise that the guy is actually in prison....

I was thinking "How is his daughter still living with him"?

But this just about sums it up...

The court ordered a Santa Clara County judge to resentence Joseph Gerber, convicted in 2009 of possessing child pornography and furnishing drugs to his daughter. He was sentenced to 13 years and four months in prison. The court said the teenager's mother suggested to her daughter in 2008 that she work to build a relationship with the girl's father, Gerber, from whom the mother had been separated for about 12 years. She later told her mother, who called police. Officers who searched Gerber's home did not find photos of his daughter in her underwear, but saw pictures of her head superimposed on seven pornographic photos of women's bodies on a computer drive, the court said.

So he was actually trying to get his 13 year old daughter to pose for photos.... he was plying her with drugs also, I'm sure this was only heading in one direction.

The guy is sick and deserves to be locked up.

Again, bullsnip. The reason you see children of 12 being tried as adults is because America is rapidly becoming an Idiocracy full of blood thristy morons who want children treated like adults for their own sick reasons, certainly not because the science justifies it, or the law requires it. We are overturning good law and precedent TO punish children as adults to satisfy these morons.

Children are not supposed to be held to adult standards because their brains have not finished developing yet and its ridiculous to hold them to the same standards.

But AGAIN, we are not talking unconscious 'lust'. we are SPECIFICALLY referring to conscious, intentional, extended sexual fantasies.

why do you keep quoting 'evil' when I never used that word?

It's almost like you have the inability to argue what someone actually wrote.

Thoughts are thoughts. It's not illegal, and it's not morally wrong. Is it normal? That's up to you to decide. I am saying this man has the LEGAL RIGHT to masturbate over FAKE pictures or fantasies if he wants to. The option is there, and some people are going to use it. I have made it more than clear why we can't punish this type of thing.
