the bill would have required the bank to produce a chain of title, to prove ownership....
and the bank felt threatened enough to reduce the guy's mortgage by over 50%...

I was looking at some of the real estate auctions online, mainly the foreclosed homes being auctioned off....
alot of them appearantly didn't have that chain of title....since well, they come with a quitclaim deed, or worse...a special warranty deed which gives a limited number of assurances about the seller's ownership in the property being conveyed.

the have muddies up the chain or ownerships, there is no clear deed for these houses, and it has nothing to do with these particular houses going into foreclosures....since well, that muddied chain or ownership is what prompted them to resort to robosigners and crap like that. why should any of us homeowners believe we can get a clear deed for our property when we decide to sell it or pay it off???
If I am right here, the banks should be reducing everyone's mortgage by about 50%, since it was their actions that have effectively reduced the value of our homes, since well, it will never be possible to prove who really owns them!!!

Yes, this "chain of title" has become such a messy and sordid path over the years. Far cry from mortgages in "It's A Wonderful Life". A nightmare for homeowner, buyer, seller, lending/servicer institutions.

How to Corrupt State Government

For nearly two decades, Alan Robbins was a master strategist in the state Senate. Now, as a prosecution witness at a political corruption trial in Sacramento, the imprisoned former San Fernando Valley lawmaker is describing a system full of trap doors, sidetracks and other devices designed to block proposals at the behest of special interest campaign contributors. Here are some of the key ways Robbins said he manipulated the Legislature to corrupt ends:

1) COMMITTEE ASSIGNMENT After a bill is introduced in the Senate, it is sent to the Rules Committee for referral to a policy committee. "This can be the most important step," Robbins said, because assignment to one policy committee or another can determine whether a proposal passes its first hurdle or is bottled up. "When the Rules Committee wants to kill a bill or make it hard to get a bill through," it will be assigned to two policy committees. "They are creating two different opportunities to kill the bill," he said.

2) COMMITTEE HEARING Robbins, former chairman of the Senate Insurance, Claims and Corporations Committee, decribed the policy committee hearing as a "critical step" because the full Senate tends to follow the panel's recommendation. "Most bills are killed in committee," not on the Senate floor. If Robbins wanted to shoot down a bill before his committee, he would "look at my watch" and say that he was going to quickly put the measure to a vote, especially when not all the committee members were present.

3) JUICE BILLS Some bills are considered "classic juice bills"--a piece of legislation "where you have financial interests who compete against each other." He said such legislation provides "political room to go on either side (of the issue) and (therefore) both sides are out there giving (campaign) contributions."

4) STUDY IT Other bills are sent by policy committee to "interim study," which Robbins describes as another "way of killing a bill but making it look like you're not against a bill." In other words, the proposal is dead "but we're going to study it."

5) THE ALAN AMENDMENT If a bill was not to his liking, Robbins said, he could amend it to become more favorable to his interests. "I don't want to sound immodest, but basically an Alan amendment was an amendment that was written in such a way that no one could vote against it. It would be motherhood and apple pie."

Just curious. How much does a senator in AZ make a year? Why was his house in foreclosure status and needing loan modification in the first place? That seems weird. A lot of politicians are condemning regular people for buying more house than they can afford, yet this guy needs a loan modification? Forget the bribe. I want to know why he was in that position in the first place. It's clearly a conflict of interest and he should have not been the one in charge of introducing the bill.

The protests will be done at the polls

the picket signs will be articles and facts sent out.

Standing in front of a building accomplishes nothing...Wisconson proved that...so, recall, vote out, and get actual facts out..that is the only possible way things will change for the better in such instances.

Actual protests? inconsequencial
Violent retoric? nonsense

use the tools we have in place to call forth the republics revolution...the power of the vote, the power of facts.

In part, the best parts of ATS are about exploring exactly that question. Mostly, it's been a long-term, focused effort to prevent people from thinking the wrong way by preventing them from thinking at all. The reason it's now on the surface is the same reason a dandelion shows up through the dirt -- there's a very large network of roots deeply supporting it which were growing there for quite some time before the flower bloomed.

Not much, It is a part time job, probably 20-25k a year is my guess. I know of another rep who got voted out last term who held a second job the same time they were in the legislature.

Look bottom line, the banks CANNOT prove title to a large percentage of the loans done in the last decade, basically any transferred through MERS, because a transfer through MERS violates nearly every states laws. Even if state law requiring registration of transfer with the state did not exist, the evidence is overwhelming the transfers were signed off on by people making minimum wage claiming to be bank vice presidents - and are not binding for that reason as well.

There was a 60 minutes story on one of these document signing operations a few weeks ago. In that piece a man admitted he signed as a woman, Linda something as vice president for dozens of banks - 3000 times a day without ever looking at what he was signing. They also talked to a woman who notarized all these documents and she admitted she knew that the person signing was not Linda, and never witnessed the actual signing. The reporter asked her does she know what notarizing something means and she said yes, then why did she do it - because her boss said it was OK.

Worse than all that, there seems to be a lot of evidence a ton of original paperwork was intentionally destroyed so that the only chain of transfer is what is an electronic record in the MERS system. This was obviously done to threaten Armageddon if MERS was not allowed to be viewed as legitimate.

What I don't think hardly anyone grasps is this is not just the banks problem - anybody that has a house that was transferred through MERS may not be able to obtain clear title once they have paid it off - because the bank they are paying does not possess it to give them. There is now confirmed cases where the same houses were promised as collateral multiple times in different MBS packages. There has even been reports of fraudulent second mortgages created and sold.

This situation is NUCLEAR if it comes out - and really I don't see how it won't short of getting every state to retroactively change their property laws, and the fed government making MERS transfers by means of fraud legal - I'm not even sure that is possible.

The banks are going to do anything - ANYTHING to try and stop this knowledge from getting out. Government too - what do you think happens to property values and the entire economy if it gets out 90% of the mortgages created in the last 10 years have this problem?

You know the sad thing is that none of us is surprised about this kind of thing anymore.
We know that our public officials are corrupt. But you know what guys it isn't enough to just blame a few of the people in the system for taking advantage - its the system itself that allows them to take advantage.
The only way is to change the system, not by voting in the same people year in year out.

Fannie and freddie don't own most of the mortgages.
Its MERS not mres
it was created by banks to avoid title registration everytime that a MBS was sold to a different bank

the government owns fanny and freddy not the banks and fanny and freddy own 90% of most mortgages in this country.

those same people who created fanny and freddy also created mers and the depth that mers was allowed to operate came from government approval

and the two democratic senators frank and dodd.

nice attempt at a deflection to lay all the blame of banks but even still those same banks get all their cash from the federal reserve.

still have to get the nodd from congress.

the entire blame goes to congress deal with it.

The government makes the banks be bad, bankers don't want to cheat,the government forces them to be cheating.

We need to get rid of elected officials and replace them with bankers, even Jesus had 12 bankers follow him around
due to their character. Now if a banker gets elected to a position in the government he is instantly evilized, sorry dude but the banks are good guys who are very honest and victimizated two much!
