People actually tend to believe that Habeas Corpus only applies to American Citizens....
I read this BBC article, all they say is that Obama and the attorney general WANTED to try him in US Federal courts, and were prepared to do so but blamed Congress for the reversal:

Mr Holder blamed Congress for the high profile policy reversal, saying his hands "were tied" by "unwise and narrow" restrictions they had placed on the administration.

But, he said, the Justice Department had been prepared to "bring a powerful case" against Mohammed and his four co-conspirators

Mr Holder noted though that the death penalty could be still sought in the case.
They don't really go into detail about the "unwise and narrow" restrictions imposed by congress, anyone have the scoop on those?

And from that it's not clear that they intend to seek a death penalty, if they don't, there will be nothing for Obama to sign. It only says they COULD seek it.

Huge newsflash for all of you death-penalty supporters - you don't have to be 'far-left' (definition required!) to oppose the death penalty.
The USA is one of a handful of nations that has capital punishment. (21%) and you should not be so thrilled about the other nations with whom you share this distinction. To quote Wikipedia...
"Capital punishment has been used in almost every part of the globe, but in the last few decades many countries have abolished it. Usage of Capital Punishment is usually broken into the four categories set out below. Of the 193 independent states that are UN members (or have UN observer status):

* 41 (21%) maintain the death penalty in both law and practice.
* 95 (49%) have abolished it.
* 8 (4%) retain it for crimes committed in exceptional circumstances (such as in time of war).

Wikipedia Death penalty nations

I am skimming the Wikipedia article and I note that Venezuela, one of your 'enemy' nations abolished the death penalty in 1863. New Zealand's last execution took place in 1957, and newsflash, we currently have a right-wing government and have done so for most of the time since 1957...

Frankly, your retention of a mediaeval system of "justice" is one of the reasons why the USA is not considered a civilised or even a developed country.
