I am curious. What are the penalties for taking a picture in a public place and getting people in the picture? For instance if I was taking a picture of the cathedral in munich and you happened to get into the foreground of the picture is that protected or is it just if I take a picture specifically of you, perhaps because you had a goofy haircut or something like that. How is such a law enforced? Is it subject to a civil lawsuit or are there criminal charges that can be filed? I really am simply curious about the subject since half my family lives in Germany and I have visited several times taking pictures at will of both countryside and countrymen.

Of course most people don't care about them being on videos and photos. And if they give permission you are free to do anything you like anyway. The background is simple: The law is to prevent private espionage/monitoring.

Would it be allowed to monitor everything without permission as long as it's in a public place we all wouldn't like that or?

In general you can say it like that:
If somebody is photographing/recording a video in a public place and you happen to be on one of the shots you can't ask him to destroy it.

We had a lot of people calling the tv station back in my days there, who angrily told us they will report to newspapers(uhuuu! hehe) that they had been recorded without permission. Well - all of those turned out to be filmed in group of people on a simple overview shot and similar incidents.

We can say it is important if the focus had been on your person or not. As I said it should prevent that people could monitor others legally. That's a privilige for law enforcement and secret services.

Maybe somebody reminds the bomb attack a few weeks back in Cologne. It was on ATSNN and not very much discussed here, just the usual "must be terrorism or racism"-shouts. Anyway, turned out to be a war going out of hand by some criminal gangs.

So they had been trying to get the bastard who placed a bomb as a tv station offered a video from their surveillance camera which showed him. The problem with the video was that it recorded images from a public place. Not from their building but like half of the street. And that's forbidden(if not done by the government)

I find it strange that Germany would regulate the videoing of a public place outside of a private business. It would seem a better use of the law to regulate the use of such video rather than the taking of it. Obviously using the video for the purposes of apprehending a criminal who bombed or burglarized the premises this should be a valid use. If however someone were to use the video to post a couple who is kissing in front of the building to the internet this use should be deemed illegal. I am also puzzled that government is given the right to video anything they want in public places but private entities cannot. I fear that Germany is putting too much trust in their government and allowing them to take liberties not afforded to the common citizen. My opinion would be modified if the PTB in Germany needed to get a warrent or other official approval to exercise the special right to video public places.

Ok, I think I passed it through not very precise. Sorry, it's always a hazzle to talk about complex issues in another language. It's even hard riding the paragraphs in german


Of course private persons can video how they like it as long as they don't monitor other people.
It's indeed the difference between making a video and monitoring.

Here is further proof of the perversity of this society when it comes to women. This is from another article on camera phones.


�I stopped going to wedding parties after I heard many stories of girls� pictures appearing on Internet sites. I definitely do not want some sick person to take my picture and distribute it on the Internet,� she said.

Um Abdul Rahman said, �My friend got divorced because her picture was circulated on e-mails. Her picture was taken inside a wedding hall in Jeddah. Her husband blamed her for the incident and divorced her.�

She asked if destroying families by separating couples was what these sick people wanted. Parents should not allow their kids to lay their hands on these camera phones, she added.

You will notice in the above post how the husband's cruel treatment of his wife who was the victim of a camera phone went unupbraided. He divorced her because some nut took her picture. These were not even porn pics. They were just pictures of her face. Now I realize that arab society frowns on showing a woman's face but this is stupid. It is like divorcing your wife because you were robbed. Personally I think the whole cell phone thing is a propaganda campaign by the Saudis to bring more secrecy to their nation lest the truth of their barbarity get out to the world in shocking photo realism.
