One small step for the Constitution of the United States. One giant leap for Americanism.

Succinctly what is said is that Obama can't call a penalty a tax. ObamaCare can't Constitutionally fine you by saying they are adding another tax.

This is great news. The very little I read about this seemed that it was a state judge in VA? It also seemed to be related to commerce laws and that the government basically can't force people to buy something. It's refreshing to see a judgethat has both brains and balls for a change and to see the judicial branch policing the executive and legislative branch, as it should be. Don't hold your breath though, I'm sure this will eventually make it to the Supreme Court and be overturned...

Too little, too late. Judges for a very long time have considered the constitution to be one of the least important legal documents there is. They treat it as the lowest law of the land in most cases. Its sickening.

The hero of this story is Virginia Attorney General Ken Cuccinelli....watch his name pop up more frequently in the future.

Doesn't matter one bit.

It has to go to the 4th Circuit Court of Appeals in Virginia next, and that is controlled by liberal judges.

Slow news day...let's try to make a big deal out of one (very conservative) Judges opinion.


Oh yeah...let's not even mention the other states where the lawsuits have been ruled against and/or thrown out.

Possibly you haven't been following the news closely, or you haven't consulted an attorney as to what has happened. Judge Hudson's ruling went to the 4th Circuit Court of Appeals ALREADY.

If you need some reference to get you up to speed, here it is for you:

The Justice Department, which is defending the statute, is also considering whether to appeal Judge Hudson’s ruling to the Fourth Circuit, which hears cases from Virginia and four other states. That would leave that court to consider opposite rulings handed down over two weeks in courthouses situated only 116 miles apart.
The Richmond ruling is the latest in a string of recent setbacks for the Obama administration, following the Democrats’ loss of the House in the midterm elections and last week’s intraparty mutiny over Mr. Obama’s agreement to extend the Bush era tax cuts.
