While I agree that it is pretty disturbing, disgusting behavior. Making what he did illegal would be a case of laws going too far.
Plenty of things are used the same way as a "dildo". If he was waving his fingers at them, and sucking them should he also be arrested? What if it
was a beer bottle, or a cucumber, or his fist?
I've seen many a guy make the "jack off" motion, I guess to denote "yeah big deal", should that also be illegal?
What about suggestively sucking on a lollipop? Should that be illegal?
Other than making "sex toys" illegal (which in turn opens up a wide range of interpretation, are my fingers sex toys?), there's not much you can
hope for here.
I personally don't think what he did should be illegal, outside of harassment.
When you start on this slope where do you stop?
Should a picture of a dildo on a shirt be illegal? What if I'm in a supermarket and kids see it? Hell I have a topless woman tattooed on my chest,
should I be arrested if a kid sees that?
Should it be illegal for men to wear tight pants that show a "cock print"? Should cleavage revealing clothes be banned? How about short skirts that
show alot of thigh? What about thong bathing suits?
All can be construed as sexually intimidating. What if a chick has a very revealing outfit on that gives me more wood than a woodchuck could chuck? Am

All that being said, if I walked out and saw him doing this in front of my kids he'd catch a swift ass kicking. But, I wouldn't be calling the
police on him.
