There is a legal term for this situation called "A Priori", meaning being without examination or analysis(look it up if interested). To challenge this law the gov't would have to actually have proof that it violated some persons civil rights, you can't just challenge a law in court and say it can or in theory it could violate a persons rights, they have to prove, yes evidence, real recorded incidence that it violated people civil rights.
