I'm split on this. She did a disgusting thing and punishment is in order.

However, recently, people are getting away with murder, literally. That lady here:
en.wikipedia.org...

She gets 210 days in prison after killing her husband with a shotgun. She gets credit for pre-trial incarceration. Goes free soon thereafter. There are allegations of abuse by her husband (ridiculous IMHO), which are enough to replace the 1st degree murder (pretty obvious to me) with manslaughter.

It's all wrong. Mrs Winkler should get life and that molester should get 20 years and stay away from kids thereafter.

So you have read her full psych eval in order to come to that conclusion correct?

No, I base that on the fact that she refused a plea bargain which would require her to register as a sex offender as she didn't believe that her crime warranted it, I infer that she doesn't think her actions are wrong and so why wouldn't she repeat them?

She definitely shouldnt be treated any differently than a male, but a life sentence for this violates the 8th Amendment, as do many other mandatory minimum sentences.

Probably, but if this is the case she should take it up with the supreme court.

Personally, I think that if there is any good in the prison systems, it is that it offers a level of protection to society from people who have been proven to be willing to damage children for their own gratification.

It's up to her to prove that she won't do this again, and she gets her chance in 10 years when she comes up for parole.

Who ever claimed that they found this woman's behavior acceptable?

I didn't point at you, but read back over the thread.

-I mean, obviously if the young boy is traumatised for life then the sentence should reflect that. However if the boy is high-fiving his mates, and otherwise bragging, then the sentence is about as harsh as it gets.

Really?? You took that as me condoning it?

That sentence highlighted polar opposites in order for me to make my point.

Perhaps my very next sentence might've given it away:

So youre ok with a life sentence for having a 13 year old touch a boob?

Seriously?

She could have raped and then murdered the child, and probably got a lesser sentence.

Did you actually read the news article, or are you just "winging it" based on the headline? Obviously the latter because you left out 2/3 of the charges against this woman in that statement.

Doesn't anyone see that the true criminal in this case was the D.A. who forced the case? I'm absolutely sure there were other options.

As far as I can see, the D.A. has wasted a huge amount of tax money, made an egregious error of judgment, and most likely allowed his or her personal biases to effect the path of this case. Whoever is responsible for this travesty of justice will very likely, has very likely made similar errors in many other cases. If I were local, I'd be checking the records for similar cases of over-charging the crime, and sue him or her to recover the wasted tax dollars.

The original crime was trivial compared to the assault on common sense and true justice the court perpetrated.

I addressed this on page 2 of this thread. Watch the video in the original post. She's wearing a large orange suit.

Here's the point.

Did she do wrong? Yes. Let the punishment fit the crime.

BUT - Like was said earlier, if she would have murdered the boy and received a lesser punishment, that is a error in the system.

I'm all for lifelong and capital punishment, but it should for sure be proportional to the crime.

Well what is the potential or actual mental and or physical damage? Does the punishment match the crime. We all know any form of abuse of minors is wrong. Perhaps someone could post some serious academic papers that identify how a teenager that is 13 can be abuse by touching a breast and a saucy invitation from an older woman.

Before People get steamed I can neither understand paedophiles nor condone them but frankly this does not seem major. IMHO laws are made of rules and precedents but everything must be tempered with common sense. Perhaps this is all a sad reflection on “Victim America”.

Can’t more heterosexual men remember being 13???? I confess I dropped a whole grade due to obsessing about breasts. Or is it just me??

So how do we protect other children from this woman and her sick desires?

You can't mostly because we don't talk here about children but a 13 year old boy and trust me, they're sex driven, they know what sex is, some of them even had sex allready.
I can give you an example: I like to chat, in a german chat, basically i try to find people who share my interests (and they're not about sex) and you wouldn't believe how many 13,14,15 year old boy write me and ask, if i want to see their penis, if i want to see them masturbate, if i can send them nude pictures, if i masturbate for them in front of a cam (i don't own one) and some even ask directly if i would like to have sex with them. Children as young as 11 years even asked me.
The real truth is: As soon as children enter puberty, they aren't children anymore and times have changed, maybe 50 years ago it was different but by now, even as soon as 10 year old they know what sex is, watch porn and can't wait to have Sex.

Like i said i'm against pedophiles, i'm against people who take advantages of children. But kids over the age of 12 are so different today, that basically we have to be saved from them. You know, i really wait for news like "15 year old boy rapes 30 year old woman" or something like that. It will happen and nobody should close their eyes from this horrible (in my oppinion) truth and think that all children and young teenagers are innocent angels.

The sentence is way to long for that woman, even though she did a bad thing.

Dude, she fugly.

Poor kid. I could give two damns what her sentence is. Can't get with someone of your own age because you can't stay in shape and actually care about your looks doesn't give you the right to coerce a child into acts.

Sickening.

First Prison is a Problem not a solution. Prison is torture and a life sentence
is unconstitutional for any crime.

Second the age of consent for consensual sex is 16 in many states and therefor should be for all as this is one country.

Therefore if a woman of any age propositions a boy of 16 it is not illegal since you cant have sex without a PROPOSITION for it. Most boys between 13 and 16 would like to have sex.

Her conduct was to ask for sex,and the boy turned her down. No harm,no foul. He was old enough to defend himself.
If she had been beautiful he would not have turned her down. Even if a man of 60 asks a WOMAN of 16 if she wants to have sex with him there is no crime committed.

Those who want to see her burned at the stake (life in prison) are EVIL MONSTERS who should be put in prison for life.

I could just as easily say that those who want to see her exonerated or let off easy are child molesters rallying to save one of their own.

And the boy was 13 - not 16. Regardless of whether or not the min. age in some states is 16, fact is - he was still 3 years under that.

So let's dispense with the insults, mmkay?

I don't think anyone here is standing up for her, or for child molesters in general. They (including me) just feel that life in prison is a ridiculous sentence.

Would you agree to jail a 12 year old kid who stole a candy bar for 6 years and 5 years of probation thereafter? No, that would be ridiculous too. Am I telling everyone that stealing candy is ok? no.. I am not...

This is a case of too much power. There needs to be limits.

Your position is its ok for a women to have sex with a 16 year old boy (which is the law) but she should get life in prison for asking for sex with a 13 year old boy.

I say that is an Evil position that is not consistent with any rational arguments. Life in prison should be reserved for real crimes.

Her conduct may be socially inappropriate but it does not amount to a crime requiring imprisonment.
