The state often wins, but does not always win. There are gray areas of Tax Law. However, the constitutionality or legitimacy of the Internal
Revenue Code is
not one of them.
You should keep in mind that judges do not like paying taxes either. Judges implement all sorts of business planning and estate planning schemes to
reduce their own tax bills. Judges are not going to take harsh pro-government stances because their decisions may end up hurting themselves.
