A fifth state – South Dakota – has decided that guns made, sold and used within its borders no longer are subject to the whims of the federal government through its rule-making arm in the Bureau of Alcohol, Tobacco and Firearms, and two supporters of the growing groundswell say they hope Washington soon will be taking note.

South Dakota Gov. Mike Rounds has signed into law his state’s version of a Firearms Freedom Act that first was launched in Montana. It already is law there, in Tennessee, Utah and Wyoming, which took the unusual step of specifying criminal penalties – including both fines and jail time – for federal agents attempting to enforce a federal law on a “personal firearm” in the Cowboy State.

According to a report in the Dakota Voice, the new South Dakota law addresses the “rights of states which have been carelessly trampled by the federal government for decades.”

“As the federal government has radically overstepped is constitutional limitations in the past year or so, an explosion of states have begun re-asserting their rights not only with regard to firearms, but also in shielding themselves against government health care, cap and trade global warming taxes, and more,” the report said.

South Dakota’s law specifically notes “any firearm, firearm accessory, or ammunition that is manufactured commercially or privately in South Dakota and that remains within the borders of South Dakota is not subject to federal law or federal regulation, including registration, under the authority of Congress to regulate interstate commerce.”

In my opinion they should have gone further than that. For example, in Wyoming a similar measure was adopted by the state, except that it also includes fines, and imprisonment to any Fed agent, or other agent working for the Feds who attempts to enforce Washington's rules on firearms. The penalty in the cowboy state is for two years in prison, and $2,000 for any federal agent who attempts to enforce federal gun rules.

Every state should adopt similar measures, but not only in regards to our second amendment rights, but other rights which are being trampled by the Federal government, as well as their massive theft of American's money, and other tactics which are increasing our debt, and dependence of countries like China which hold a large protion of our debt.

It is time for the people, and the states to tell the Feds, and their government that they are serving the people, and must abide by the Constitution, and the Bill of Rights within it.

Let's hope more states adopt similar measures.

In the original link there is also a map of the states who have passed FFA (Firearms Freedom Act), those who intent to introduce FFA, and the states which apparently have no intention, or plan to introduce such legislation, which only intents to force the Federal government to abide by the Constitution of the United States, and the rights enumerated within which include the right of every citizen to own and bear arms.



The states which have pending legislation or plans to introduce the FFA include Alabama, Arizona, Colorado, Florida, Georgia, Indiana, Kansas, Kentucky, Louisiana, Michigan, Minnesota, Missouri, New Hampshire, North Carolina, Ohio, Pennsylvania, South Carolina, Texas, Virginia, Washington and West Virginia.

It is nice to see how the oposition to such measures make their argument.... Such response shows who really are "ignorant beer jockeys"....

Federal law only trumps state law in the specific ways laid out in the US constitution.

The 10th amendment clearly states any power not granted to the federal government through the constitution is purely the jurisdiction of state governments.

Sadly this part is true, a showdown has been slowly brewing between between state and federal power. This made me wonder though...suppose the state the federal agent runs too has similar laws and is unwilling to protect him. Things could get a little tense.

Hopefully that will play out in a court room.

That is the gist of the matter, IMO. A school or group crying " OOh, free money, gimme gimme." Then the contract- and it is basically blood money.

Obviously there are people, like "thewalkingfox" who are ignorant to no end. To these sort of people it doesn't matter even if the forefathers themselves CLEARLY explained the Second amendment, time and again....

I guess according to "thewalkingfox" none of the above statements, and many more, state CLEARLY what the forefathers intended for the Second Amendment....

You, drwizardphd, are the exception to the rule as you should know that most Liberals, as well as most Democrats are gun shy to the point that they think the world is going to end if they just think about a gun....

There are some people who are extremely ignorant about the history of this country, and the rights enumerated in the bills of Rights within the Constitution. Many of these people think that in order to be civilized you must give up your right to bear arms, which is of course nothing more than a red herring, and an ignorant claim.

The right to own and bear arms is as important as the right to free speech, which as it is it has been restricted by the government, and in the same manner they are trying to restrict, and even ban the right of citizens to own and bear arms because an armed populace still has some control over the government, more so if that government ever becomes dictatorial.

Once the right to own, and bear arms has been taken away, there is nothing that will stop such a government from becoming dictatorial.
