This is another victimless thought crime that our society is pursuing in order to enrich lawyers, prisons, and create security for those in the justice system. It is also a violation of a basic freedom, a right of free speech. It won't be long before we start burning books and works of art because of such sensationalism.

Just another thread that helps explain how screwed up the world really is. First the title is a little misleading....how about man arrested for simulated child porn? Secondly, some things in life are wrong, some things are right....blurring the line for a false arguement and making the previously wrong seem to maybe be o.k. just helps destroy the moral fabric of the world just a little bit more.

This arrest only shows that the Puritans are still trying to implement "thought Police".
Sadly, The Puritans(read: The Christian far-right fringe ) are still a power to be reckoned with in America "The Land Of The Free" .... yeah...rrrriiiight...

Americans on vacation in Europe STILL get palpatations if they see a woman topless on some beach, let alone if they see some teenage girl walking around topless(quite common I have to say) They ogle, almost salivating, but still spew hypocritical comments about "how disgusting all that nudity" and how degenerate Europeans are. Porn in all forms and shapes is , in general, freely available overthere, yet, the interest in it is slowly but surely declining. Porn-mags lead a petering, sad existence. Their biggest revenue nowadays is on-line, with a stunning amount of American IP's in their member-lists.

Japan? Well, the craziest violent pornographic stuff is freely available, yet a woman can walk around, quite safely, in about any city at night without the risk of being assaulted, or even raped. Children walk by hard-core porn manga/hentai, that even made my jaw slam on my chest, and go straight for pokemon and his ilk. And no, they do not need counceling for having seen nekkid people doing "grown people-stuff". They giggle about it and go for the stuff they like.

I have seen guys in the Subway reading the most graphic sexual stuff(yes, kiddie-hentai too), no-one batted an eye, no-one started to suddenly jump children... When I began looking around in earnest, I even notice several women(of different ages) with, what americans would describe as "porn".. in public! I tell'ya.

Buuuut in America?? You'll even get jailed for the posession of pics of your own children having fun in the garden, albeit buck naked. Lord Almighty!! Get a grip!

America, as a country is SO bloody backward in that regard, soo narrow-minded and stubbornly stuck in the 50's, that I am having more&more trouble adjusting when I am "back-home" In Mi. The only places You'll meet people that couldn't care less about Porn, nudity etc. etc . Would be New York and maybe that pit of gay decay(just kidding) Frisco......, but only just.

Only advise: Every American should at least once in his lifetime go abroad and experience something different for themselves.

Pfffft, whatever..what am I getting worked-up about anyways. The Tought-Police has won..again...

The title is perfectly fine, they are cartoons of children and i went on in my original post to say exactly what the cartoons were depicting according to the police. So i mislead nobody.

I also am not arguing that the images are wrong, morally speaking. To me they are abhorrent, however i also understand that freedom of expression is a very important thing and as long as no one is harmed then we can't ban things just because we find them morally wrong. If you want to go down that road then everything can be banned including many things i'm sure you enjoy.

You see if we base banning things solely upon moral outrage then someone somewhere will ban something you enjoy. Like meat? Well some thin that it is horribly immoral. That's an extreme example but you are just talking about things being wrong and therefore they should be banned.

I am blurring no line, i am saying clearly that these images are wrong, but as no one is harmed there is no victim and so no crime.

Actually, on the topic of Twilight, it is a form of Bestiality (inter-species love making). But the last time I started a thread on that can of worms it got a bit heated and wound up being deleted because ATS didn't want to see a topic about 'bestiality' on their front page, lol. Free speech indeed.

ooh, that reminds me. Just read that in The Netherlands, bestiality is now officially forbidden by law.. Only a christian party could have cooked that one up. I would have never thought of sex with animals, let alone cobble up a law to prohibit it..

As I understand it, the Christian right has a powerful position in government overthere and they constantly try to regulate people's (sexual) behavior. Talk about a "sick obsession".(And one party even tried to prevent women to be able to vote or be in a eligible position...So far 'the separation of church&state". Who needs Islam, with Christian countries like that
:lol

Knowing how to read Dutch can be fun sometimes...

Which court case? The guy is already in prison and any images like this will in future be treated as criminal.

OUTRAGEOUS!

That poor comic collector, was NOT looking at CHILD PRON, those moronic cops and investigators have eaten too many doughnuts and now everyone from cop to judge has fat for brains.

From the article:

"The 40-year-old was charged under the 2003 Protect Act, which outlaws cartoons, drawings, sculptures or paintings depicting minors engaging in sexually explicit conduct, and which lack “serious literary, artistic, political, or scientific value.” Handley was the nation’s first to be convicted under that law for possessing cartoon art, without any evidence that he also collected or viewed genuine child pornography.

"

I remember when this 2003 act came about, and it outraged me then too.

Japanese cartoon pron is often called

HENTAI.

Here is a link: (warning for all the prudes in the house, enter at your own risk):

It is just the google results page, so the choice to learn more about why an innocent man was jailed is in your hands no pun intended.

My god this topic burns me up. I have kids and I hate child sex crimes.

But I am also for freedoms.

Now lets see, the poor guy was jailed under the 2003 act which allows for artistic renderings.

Manga and hentai are art forms of a different culture, and this guy got judged by a bunch of ignorant PIGS who do not know how to follow the law themselves and research whether or not this was indeed artistic.

These types of incidents will keep happening, and happening, until we the citizens TAKE BACK OUR COUNTRY!!!

He only got six months, too, so not only did the PIGS jail him under false pretenses, they KNEW it wasnt right so they only gave him six months (and this involved FEDERAL PIGS!!!!)

"Without a plea deal with federal authorities, he faced a maximum 15-year sentence."

Here is what the fans of this ART FORM have to say (hey, what do you know they are outraged too):

"Comic fans were outraged, saying jailing someone over manga does not protect children from sexual abuse. “I’d say the anime community’s reaction to this, since day one, has been almost exclusively one of support for Handley and disgust with the U.S. courts and legal system,” Christopher MacDonald, editor of Anime News Network, said in an e-mail."

Your right...just read the actual story...

the guy was a idiot first off to plead guilty...in order to successfully prosecute such stuff, they must turn up a birth certificate of the actors/actresses to prove they are in fact underage. Sounds like they scared him into pleading guilty.

knowing the law is important...and having a decent lawyer.

It would be more worrying if he plead innocent and the court then found him guilty...then it opens up a mega slippery slope. They cannot bring up a case where someone plead guilty, but they can bring up cases where people were found guilty.

also...weird sentence..6 months in prison...thought you do county jail up until a year. wonder if they simply worded it wrong.

Anyhow, not sure whats worse here...the state trying to prosecute thought crimes, or this guy actually pleading guilty without even trying to state the obvious...they must have intimidated the guy incredibly...mixed with a really crappy lawyer of course.

on a personal note...I find hentai/manga not to my liking..the big bugeyes, the voice, the (often) animal parts like tails and ears, etc...but I know plenty of people whom love that stuff. its a genre that frankly is not of my taste but something I dont even associate with CP..

The true name of this thread should have been: Should things we disapprove of be made illegal? Thats really the crux of the matter here.

holy sh43...didn't even know of this gem...I would have pushed this into the "quacky conspiracy theories" if someone said it was going to happen...

so, a court can decide what looks underage, and then also decide if it has merit...and this was passed by "freedom loving republicans"?

You know what i find odd, there are many greek statues and roman ones that depict children. If someone spent months carving out a marble statue of children now, would they have to answer to this law? Or would the court decide it had merit as it was obviously art due to the amount of time spent making it?

That would be a very interesting test.

Slightly off topic but related:

Rape 'victims' in hentai game ask players not to sue
Developers come up with creative disclaimer to bypass rape game ban

After the Western world caught wind of Japanese rape games -- thanks to someone who posted a RapeLay item on Amazon -- Japan completely banned rape sims.

As any gamer can tell you, however, there are always ways around such rules. A certain hentai game called Shinobiryuu, released just last week, comes with a rather creative disclaimer for its rape scenes.

Perhaps inspired by live action porn, the developers included a declaration in the beginning stating that the game's characters are all specially trained and are only acting out rape scenes, not actually being raped.

This is a declaration made with the consensus of all the characters that appear in this story.

All the characters appearing in this game have gone through special training and all actions carried out are done on the basis of mutual agreement.

Even if you’re a inhuman person who believes that fictional characters in creative works do not have human rights, please do not ignore this.

We also thank all the kind people who see a character in the story saying phrases such as “help me” and take it as a real call for help.

However, even though you are worrying for the characters in the story, these are all lines spoken from a script.

They are not saying all this from the bottom of their hearts. We are sorry that they have put in so much effort into their acting that some people will confuse it as something that is really happening.

This game is a fictional story.

www.neoseeker.com...

I think that blurring the boundaries firmly established by the concept of "Rights of the Person" by criminalizing cartoons (where no Person was harmed in any way), opens the door to increasingly absurd societal control.

I, personally, would not read those mangas or play those games if my life depended on it, but I agree with ImaginaryReality: freedom of speech and expression cannot be the sole privilege of the moral majority. [/end rant]

If they banned fictional child porn, then by the same logic they also have to ban fictional rape and fictional murder...
This law is absurd.

I will step into this fray with this:

I am of the absolute and unwavering belief that simple possession of ANY image no matter how offensive to the senses of the rest of the world should not be criminally punishable. When we go down that road we have situations that have happened where parents who have taken innocent photos of their own children playing in the tub have been jailed and had their children removed from the home.

If a person is involved in the trafficking or production of illegal matter it is an entirely different thing.

The problem is the authorities are not willing to expend the investigative effort to track down the real offenders so instead go after the easy targets and as a result justice is not properly applied.

Hopefully this world is coming to a better place. I am defending this mans right to possess in his property LEGAL artistic renderings of an art form called anime/hentai, which has roots in Japan not USA.

Child porn is an actual crime in which a REAL LIVE BORN INTO FLESH child is AGAINST their will photographed/video taped in sexual acts.

This case is nothing of the sort, and from the sentence this guy received, even the PIGS do not think this is criminal, but misdemeanor territory AT BEST.
