How illegal is downloading torrents from the Pirate Bay? is it illegal or is it something they have copyright to?

It all depends on what country you live in. Different countries have different laws on downloading and sharing files.

Usually if a person distributes a copyrighted piece of information they may be held liable in a court of law according to the residing country.

Distribution of non copyrighted material is in no way against most countries laws unless the material conflicts with another law.

So in general, no it is not illegal to use the pirate bay. Although one could use it for illegal acts. There are plenty of legal files to distribute using torrents and are very popular.

Downloading torrent is fine. It's what is in the torrents that can get you into trouble.

If you are downloading something that is free for use it's not a problem.

If you are downloading something that is under copyright it is.

The reason The Pirate Bay was targeted was because they did the same as Google and countless other search engines and kept a track of how popular torrents were and indexed them accordingly for ease of use.

Granted you have to wangle Google to get it to display torrents and the Pirate Bay was set up specifically for it, but it's the Internetz.

It's much easier to glean what it's about from that.

Pirate bay just indexes torrents - like I could get anything released under a GNU licence like most Linux releases just fine.

Try to DL High School Musical and eyebrows will be raised (for a couple of reasons).

Surly you can go to torrent forums for this information?

research usenet, it is a direct download
as opposed to torrent, where you are uploading
this is how you get caught

What is interesting about this whole subject is the complete lack of discussion on the issue that 'intellectual property' rights have no relevance to the theory of property to begin with.

Property is derived from scarcity of resources. Digital media is not scarce and completely throws off any supply/demand curve. In fact, the supply is infinite because the ability to copy the media indefinitely is inherent in the format the media is stored.

I am not saying to break the law (T&C) but the law is not enforceable or ethical.

The whole 'intellectual property' issue is itself a conspiracy. We have people getting patents on genetic strands(my sig), viruses, and mathematical equations.

Soon, people aren't going to have the right to their own DNA.

Seriously, pirate bay is just a search engine for torrents. You don't download anything from it.
Broadly speaking, anything you would be expected to pay for is illegal to download.
This includes movies, music, and programs. There are exceptions, such as video and music distributed for free, open source software and "shareware" or "trialware".
BT distributes the load, meaning you are uploading while you download.
Therefore, if you are illegally downloading a file, you are also guilty of distributing an illegal file.
And, it's fairly easy to get caught at it---and expensive when you do.
BT's are a great tool, when used legally, but the vast majority aren't.

Be careful where you download stuff from PB. The best way to download T's off that site is by using any open Wifi like a Hotel, Starbucks, but never from your home. My Friend also got fine for downloading off that site but now he does it in Starbucks and no problems yet.
