Obama birth certificate deniers won a small victory in court on Monday. Meanwhile, one such conspiracy theorist refused to deploy to Afghanistan on the grounds that Barack Obama isn't a legitimate president.

A judge said he would listen to "the merits" of Alan Keyes' case challenging Obama's presidency. While a spokesman for the U.S. Attorney's Office said the move was merely procedural, birth conspiracy proponents are encouraged:

Will be interesting to see how this one pan's out, no doubt the authorities will pressure the judge to swing things in their favor and punish the soldier involved rather than really do a thorough investigation into Obama's background and the claims against him. If Obama really doesn't have anything to hide then why don't they solve this for once and reveal the full birth certificate? then these claims would be ended until then it seems he has something to hide?

I like this story and I understand the logic but that is a problem. I understand the logic. The Judge is gonna ask if the soldier refused his COs order. The soldier will say yes... His reason although legitimate will not be recognized because Obama himself did not give the order. The order cam down from a CO and the order was not followed so the soldier is in deep trouble despite the fact he is challenging the BIG BOSSES authority it was not the big boss that gave the order...

I still admire the soldiers conviction... The US needs more soldiers like that.

There is no hope for this world!

I'm reading comments about this on sites, comments on articles and stuff like that.

97% of responses are like "send him to the brig" or "have him escorted to guantanamo bay".

I can't believe it!

Too many hawks, war is the new peace.
Too many enforcing a slave mentality.

Is there any hope?

Our military sign up promising to obey orders. Even if Obama isn't valid in the chain of command, those who are over these soldiers still are. Therefore, the soldier needs to obey the orders and do the duty that he promised to do. Otherwise ... to the brig! (I just HAD to throw that in for ModernAcademia
)

Seriously .. this person signed up knowing that war was a possibility. Once he's signed up, he doesn't get to pick and choose which ones he will go to.

I have to say I'm amazed by this thread, and indeed the story itself.

Presumably this kid signed up knowing he's be shipped out to a hot spot. That makes him an idiot in my view, but we'll pass on that.

The heart of the matter is this. If he had any morality in him at all, he wouldn't have signed up. But to then pull this stunt defies description. From an outsider's point of view it looks so petty.

A valid reason would be that it's an illegal war of aggression. But of course he wouldn't have signed in the first place if he'd had that much of a clue.

It's so clearly just a stunt. Unless he suddenly came to his senses some time in basic training and found a cool excuse on the internet. But he's still a dunce.

The soldier in question is not a "kid"...he's a a major...you don't get that rank while still wet behind the ears...

And what I find odd is...some of you people are the same ones that say a soldier should follow their conscience when "ordered" to act. Now that one does, you say off with his head?!?

How come this soldier and many others not refuse orders to ship out when Bush was in charge? Wasn't he an illegitimate president? Throw him in the brig, his oath of loyalty isn't to the potus, it's to the constitution, and Obama's "illegitimacy" should not be an excuse not to ship out.
