Yes, in fact, the Commerce Clause is the excuse they use for every Socialist move that the government uses. They even used that clause to justify Medicare, and will use it for Obama's "health care provisions.
The Constitution of the US has been trashed by the SCOTUS, Congress, AND the last several presidents.

In fact, Article 1 section 8 gives no such power for Congress to enact such laws, but the activist SCOTUS has REWRITTEN, in effect, A1 S8. They have committed TREASON, but who can hold them accountable, as the highest court in the land?

The Constitution doesn't even give the SCOTUS the power it has wielded over our laws (enacted by Congress) that it has assumed for itself!

Ever since Marbury v. Madison, we have been at the mercy of a group of men and women with no "check" to "balance" their power. And they've been wrong more than right!

Time for a "change?" I "hope" so, but it won't come from BHO & Co.

Why is Monsanto so obsessed with stopping people eating natural foods? They are up to something extremely sinister...

If they get their way, the only way you will be able to produce natural food is to grow it hydroponically in some secret location, and no doubt you will go to prison if you are caught.

Think I'm joking? Give it a year or two...

It is coming to a garden near you. You won't even be able to give food or preserves away. What happens to Birthday cakes? Homemade fudge? Pitch-ins? This is no joke!

This makes me sick just thinking about it, the backbone of the U.S. is the farmers, break the farmers, and this country WILL be in a Revolution.

I'm just going to IGNORE all these stupid laws. I'm going to plant my garden like i always do, and if i go to jail, so be it......at least i'll get 3 meals a day.

This sounds like Ethiopian Mentality and we know what happened in Ethiopia.

I only needed to read the thread title to know this was about Monsanto...what they are doing is not recent but certainly flourished under the GWB's Presidency. Most of Europe has banned Monsanto seeds, even Zimbabwe refused shipments of Monsanto grain when they were staring. They want to save their heirlooms...oh and Monsanto can sue farmers whose crops get infected/cross polinated with the terrible products and inviable seeds.

President Obama needs to take a closer look at this. First they starve us, then the ruin our seed, then they sue us and fine us. My garden's about 15 ft. X 15ft. Come seize it, A - holes! I'm using only heirloom seeds, no hybrids. If my garden gets contaminated and all my seeds inert by Monsanto products and pollens floating in the air WHY CAN'Y I SUE THEM??? Do they think they own the air too?

From what I have seen, from across the pond, all the recent food scares have involved big agribusinesses, NOT small producers and farmers market sales of produce. Since man cultivated his own crops people have been buying or bartering that produce and it has been shared by the communities. To bring in legislation like this that favours, once again, the agribusiness mega-corporations is disgusting and threatens the safe food supply of more than just the continental USA. Before long I expect we'll see the EU trying to introduce similar laws.

Who are they protecting here? Certainly not the consumers, who surely have a right to grow food on their own land and even smallholders should have a right to sell what they grow, and grow it how they like without the interference of the government and it's lawyers.

This is indeed a dangerous move they are making but hopefully brings a step closer their downfall.

Since when did the feds care about what the states' rights are? The courts are stacked with Freemasons who rule for the corporates. Under martial law, Presidential executive orders claim the right to confiscate everybody's property. The Zionists are just waiting to trigger something to provide an excuse for martial law, have the troops in place, the camps built, and are just testing the water to see how much resistance they might get from gun owners.

The National ID premises registration is finding many states ready to help the feds destroy the small farms, passing laws mirroring the feds' intent to put small farmers in a straightjacket.

The feds have taken much notice of the increase in the past few years of small farms. People are going back to the land, and the feds are concerned, working to use "food safety" to stop the trend. The consolidation won't be complete until all the small farms are eliminated as well as private gardens. The end goal is to depopulate, herd the culled population into a few urban centers, and use government food rationing to totally control the populace.

The UCC has been extended to cover commercial activity anywhere, not just interstate. You could be growing food on the moon and they still have jurisdiction.

In fact Wickard vs Filburn explicitly and famously answered this question. In exactly the sort of case you describe, the Supremes decided the feds do have authority under the commerce clause.

Filburn's excess wheat wasn't even for sale, just for his own use and consumption.

I heard on the news yesterday where people are buying veg. packets and planting there own stuff just in case.

We are having all our freedoms taken away and if we don't stand together and stop this madness then they will use us as floor mats and they will continue to wipe there feet on us.

Over here in the UK there are still many allotments around where people can rent the space and grow their own produce. With this legislation happening the US, I wonder if something similar is not too far away for the UK residents.
