SEC. 101. LICENSING REQUIREMENT.

Section 922 of title 18, United States Code, is amended by adding at the end the following:

`(aa) Firearm Licensing Requirement-

`(1) IN GENERAL- It shall be unlawful for any person other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector to possess a qualifying firearm on or after the applicable date, unless that person has been issued a firearm license--

`(A) under title I of Blair Holt's Firearm Licensing and Record of Sale Act of 2009, which license has not been invalidated or revoked under that title; or

`(B) pursuant to a State firearm licensing and record of sale system certified under section 602 of Blair Holt's Firearm Licensing and Record of Sale Act of 2009, which license has not been invalidated or revoked under State law.

`(2) APPLICABLE DATE- In this subsection, the term `applicable date' means--

`(A) with respect to a qualifying firearm that is acquired by the person before the date of the enactment of Blair Holt's Firearm Licensing and Record of Sale Act of 2009, 2 years after such date of enactment; and

`(B) with respect to a qualifying firearm that is acquired by the person on or after the date of the enactment of Blair Holt's Firearm Licensing and Record of Sale Act of 2009, 1 year after such date of enactment.'.

The intent of this bill is that in order to posses any firearm and or ammo in the USA a citizen must apply for a license. If you have any firearm currently in your possession you will be forced to obtain a license or turn it in otherwise you have committed a felony.

The 2nd Amendment: A well regulated Militia being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed.

The original intent and purpose of the Second Amendment was to preserve and guarantee, not grant, the pre-existing right of individuals to keep and bear arms. Although the amendment emphasizes the need for a militia, membership in any militia, let alone a well-regulated one, was not intended to serve as a prerequisite for exercising the right to keep arms.

This bill and bills like it clearly INFRINGE upon our civil liberties.

Its not a surprise. We all knew that when the Dems regained full control of the government, they'd try to ram through a gun ban of some sort. Heaven forbid that the 'civil liberties' party support the Bill of Rights.

Hopefully, the liberal Dems in Congress that favor banning firearms will have trouble finding support even amongst the moderates in their own party. In any case, I'm sure they're going to pass some type of ban in the next two years. With any luck, it'll turn into a long, drawn out fight and that what passes is a watered down bill that isn't particularly restrictive.

I agree with you it's not a surprise, and I hope you are right about it getting watered down. This is disgusting, it should send a signal to all
those that have been on the fence that it is time to buy a gun and stock up on ammo while you still have the right to.

National Right-To-Carry Reciprocity Bill Introduced

U.S. Representatives Cliff Stearns (R-Fla.) and Rick Boucher (D-Va.), recently introduced H.R. 197-- the "National Right-to-Carry Reciprocity Act of 2009"--a bill that would provide national recognition for valid state Right-to-Carry licensees.

The bill would allow any person with a valid carry permit or license issued by a state, to carry a concealed firearm in any other state if the permit holder meets certain criteria. In states that issue permits, a state's laws governing where concealed firearms may be carried would apply within its borders. In states that do not issue carry permits, a federal standard would apply. The bill would not create a federal licensing system; it would simply require the states to recognize each other's carry permits, just as they recognize drivers' licenses.

Senator John Thune (R-S.D.) is expected to introduce the Senate companion bill in the near future. Rep. Stearns has introduced such legislation since 1995.

I have said it before and I will say it again now.

In the event that guns are outlawed I, as a good citizen, must obey the law and turn in my guns and ammunition. I will do this with great haste and due diligence. I will first turn in all bullets and may even purchase more since I have mechanical means in my hands to render them no longer able to be fired. In the interest of fairness I will give one or two to as many elected officials as I can find so none may feel left out or particularly special. I ask all good Americans to do no less.

If a tribute to this man is to be made, forget gun control laws that won't stop these type of assaults. Give his family, brothers and friends a gun so that they can defend themselves. Once again, play on people emotions for support.

The old pro gun argument is wrong, at least for true patriots.

The argument being that "If they ban firearms only criminals will have firearms"

Now this is accurate to an extent and actually more so, Yes your run of the mill street thug law breaking punks will most certainly wield overwhelming firepower over the rest of us "law abiding citizens", However a true patriot of this republic will never submit to these unconstitutional trespasses, They will retain their arms and through unjust and unconstitutional legislation become criminals themselves, and lets pray that when that day comes we give new meaning to the word criminal.

This is just the first step. Once they know who has what and how many, the contingency plans for confiscation can then be put into place. I am not saying that confiscation will happen, but it will be considerably easier if this goes through. The next bill to follow this one will be the new and improved "assault weapons" ban. I can't wait to see how many "common sense" gun laws BHO and his cronies can push through...

All I have to say is stock up now folks...

At this point I would insert the numerous quotes from the Founding Fathers and mention that gun control was one of Hitler's main pillars to success at his vocation. I decided that I would just hope that this thread gets pinned to the front section so we can get an idea of what the ATS/BTS members think is going on.

If the inner workings of the Constitution are not clear the Bill of Rights works like this...
1) the right of the people peaceably to assemble, and to petition the Government for a redress of grievances...

If the government fails to yield fall back to...

2) form armed militias made up of armed individuals and eject the government by force...

Here we understand why these lawyers and business owners turned politician want to eliminate or obscure the 2nd Amendment at all costs. I wonder when the millions of gun owners will start to rally around the 1st and if the government does not yield to their unalienable rights will the citizens clean house with the 2nd??

So what if you have to buy a license? Big deal I gotta buy one to drive my car.

And how is this the beginning of the end for gun rights? There is another Bill, as the poster above shows, that is making it EASIER for Americans to carry their concealed weapon(that the carry concealed after buying their permit) across state lines.

I guess that this bill would pacify most people.I however believe that having to obtain a permit or a license to carry your firearm is an INFRINGMENT of second amendment rights.
A license is a government allowance for you to do something that would otherwise be illegal.The right to bear arms is our legal right.

How about we vote so that you have to have a license to say and have that opinion you just posted?

After all, rights are not yours until you get a license to use them...

I am already subject to a CRIMINAL BACKGROUND CHECK for every gun I purchase, If I'm a Felon, Committed Misdemeanor Assault, have any Domestic Violence Charges, Have any history of Mental Health issues, Have a Restraining Order against me, etc, etc, etc...

I CANNOT purchase or own a firearm, What more do you want?

Why do I need a license when I'm already subject to these things?

Three reasons,

1. To give people a false sense of security.
2. Money for licensing
3. Keeping track of firearms for confiscation.

So I assume you would be perfectly fine with having to purchase a "Freedom of Speech Card"? Since when is the Bill of Rights available to only those who have a license?

Last time I checked, automobiles aren't a protected right under the constitution, not that I agree with having to register them.

Funny how all of you right-wing gun nuts overlook the WELL REGULATED portion of the amendment. Doesn't matter anyway. Bills like this get written up ALL the time. It doesn't mean anything, it would never see the light of day, I promise. To me it sounds like most of you just want to start some type of revolution. Maybe not even a bad idea, but let us look at REAL and BETTER reasons than some house bill that is written simple to stir the pot.
