Court won't review Obama's eligibility to serve!

I am not sure here, and I have written Leo Donofrio for clarification, but according to the Court's Orders ONLY the application for stay was denied. there is NOTHING on the orders about certiorari.

Whether or not this means that this is over, I am not sure, I hope to hear from Mr. Donofrio soon

Supreme Court won't touch this case or any similar case with a ten foot pole. They are spineless and fear that people will judge them for interfereing like they did in Gore-Bush. Don't be surorised if one day we do have somebody who is ineligible because future candidates now know that they can release anything and there is nobody that can force them to verify anything.

Leo Donofrio's Public Response:

My application was denied. The Honorable Court chose not to state why.

Wrotnowksi v. Connecticut Secretary of State is still pending as an emergency application resubmitted to the Honorable Associate Justice Antonin Scalia as of last Tuesday. I worked extensively on that application and it includes a more solid brief and a less treacherous lower Court procedural history.

After six days, it’s interesting that Scalia neither denied it nor referred it to the full Court.

My case may have suffered from the NJ Appellate Division Judge having incorrectly characterized my original suit as a “motion for leave to appeal” rather than the “direct appeal” that it actually was. On Dec 21 I filed official Judicial misconduct charges with the NJ Supreme Court and I updated SCOTUS on that by a letter which is part of SCOTUS Docket as of Dec. 22.

On the chance that SCOTUS was looking at both my case and Cort’s case, I will say that Cort’s case does not have the same procedural hang up that mine does. It may be that without a decision on the Judicial misconduct allegation correcting the NJ Appellate Division case file, SCOTUS might have been in the position of not being able to hear my case as it would appear that my case was not before them on the proper procedural grounds.

I did file a direct appeal under the proper NJ Court rules, but the lower Court judge refused to acknowledge that and if his fraudulent docketing was used by SCOTUS they would have a solid procedural basis to throw mine out.

I don’t know if it’s significant that Cort’s case was not denied at the same time as mine. -His case argues the same exact theory - that Obama is not a natural born citizen because he was a British citizen at birth - as I did.

All eyes should now be closely watching US Supreme Court Docket No. 08A469, Wrotnowski v. Bysiewicz.

If Cort’s application is also denied then the fat lady can sing. Until then, the same exact issue is before SCOTUS as was in my case. Cort’s application before SCOTUS incorprates all of the arguments and law in mine, but we improved on mine quite a bit in Cort’s as we had more time to prepare it.

I was in a rush to get mine to SCOTUS before election day, which I did do on Nov. 3. But Cort’s case has a much cleaner lower court procedural history.

I’m not trying to play with people’s minds here. SCOTUS has not updated Cort’s Docket and until they do so there can be no closure.

SCOTUS does not have the time to take on every case filed by people that lost their Paxcil prescription. The constitution requires that a candidate be a "natural-born" citizen. It certainly DOES NOT require that the BC be published to the public at large. You people need to pool your money, hire a good constitutional lawyer, and then he will look at your argument, laugh in your face and take your money. The Federal Elections Commission is satisfied that Obama is a "natural-born" citizen. Noboby gives a flip whether you are satisfied or not.
SCOTUS has the power to hear a case, return a case to a lower court, or dismiss a case. That is all part of the "redress" procedure. You don't want to be heard; you want your opinion validated. Too bad!!!

If he was born in the U.S. he would have came forward and proved his case. The Supreme Court is bought and paid for. It is part of the problem.

Why didn't Hilary make a stink about it? Or McCain? Or Palin for that matter? She claims to be a "Maverick" all the freakin' time. If this whole "fake BC" thing is true, and she had exposed it during the campaign, she'd have been a hero to millions (millions more, at least, than the current numbers of her supporters).

The reason all these lawyers and bloggers can't get his Hawaii BC is because they have no legal claim to it. Hawaii state law forbids release of such records to anyone but the registrant. It's not even clear if Obama could allow Hawaii to release it if he wanted to.

You've put him in a Catch-22. Obama has released his BC. You refuse to accept it as genuine because your investigator of choice has no independent access to it. Obama could hand it to you personally but you wouldn't accept it because it comes from his hands, and thus in your mind it's immediately suspect. But no one else, due to the Law, can access it independently--thus there's no way for Obama to meet the burden of proof you demand.

Face it--you hate the man, you hate that America elected him fairly and with a solid mandate, and you're looking for excuses to discredit him.

Again, I hope the SCOTUS is prepared for a landslide of lawsuits over every single document the man signs until this issue is resolved.

And considering how the SCOTUS is currently stacked with a majority of right-wingers and crony appointments, there's no reason for them to deny this case and hand the election to McCain after the fact--unless the accusation holds no merit.

I can't speak for anyone else, but I'm not at all afraid of that. With all the research I've done on the Constitution, US citizenship law and birth certificates, I have no doubt whatsoever that Obama was born in Hawaii and is a natural-born citizen by law. No doubt.

This is not about emotion for many of us and you insult us by assuming that we don't really care about the truth and that we're "happy" about this decision because we're afraid.

I make DVD's with a bunch of movies and info. I'm on the 3rd gen and it's still pretty tuff to get people to open there minds nI still won't quit. Some are awakening and passiing the word.

The Denofrio case was silly from the beginning. There is no bar to dual nationality, and never has been.

In fact, many years ago, the Supreme Court specifically held that an American Citizen may be a citizen of any other country at the same time.

I am a dual citizen, of the US and of Canada. My father was Canadian and my mother American. I was born in Oregon, making me a natural born U.S. Citizen, so I would be eligible to become President.

There was no reason to reciew this stupid lawsuit. The question had been answered more than 50 years ago. It was just another idiot, that didn't understand either the US Constitution or US laws that filed it.

Good for the Supreme Court.

They should also throw out Berg's suit (and I think they will), because he has no evidence at all. All he has is a suspicion, and that just ain't enough.

Although I too have backed him on his BC stating that it is a terrible attempt to discredit him, I must say that I am SICK and TIRED of the 'are you racist?" BS that is being thrown around any time someone questions the actions or, in this point, the birthright of Obama. Just because someone wants to make sure that their new president is actually a citizen of the country does NOT A RACIST make them. Okay?

Back to the OP. I believe that the next case will also meet this same fate. I have stated all along that it really doesn't matter if he was born here or there. He was born to a U.S. citizen who DID NOT (or better yet, COULD NOT) revoke his entitlement to being a U.S. citizen. Period.
