Many constitutional scholars and human rights groups want President-elect Barack Obama to investigate possible war crimes. I think Bush will jump at the chance to invoke his constitutional right and issue pre-emptive pardons to those that authorized or engaged in harsh interrogations of suspected terrorists in the wake of the Sept. 11, 2001, attacks.

Does anyone know the legality of this? My understanding is that it is legal.

"legal" is a funny word.
war crimes are inexcusable. the lord may forgive, but i don't. something needs to be done about criminals that can pardon themselves.

First it was pre-emptive strikes and now pre-emptive pardons. Has nobody ever told this guy to think about what you do and look before you leap?

Heck yes it is legal, I imagine Bush will pre-pardon everyone involved in counter terrorism operations.

Regarding 9/11 I don't think he would pre-pardon anyone for anything there because it will basically require him to admit that he does in fact know that crimes were committed that day by our officials.

Heres a quote from a very good read pertaining to exactly this topic:

"Perhaps the most famous presidential pardon of all time occurred before any charges were filed. Gerald Ford's pardon of Richard Nixon absolved the former president of "all offenses against the United States which he … has committed or may have committed or taken part in" between the date of his inauguration in 1969 and his resignation in August 1974."
