Deputy takes man's Xbox during traffic stop

The known hazards of "driving while black" may have to be amended to add those of driving while black, dreadlocked, and toting an Xbox.
When Kenyatta Hillman and a friend were pulled over by a Orange County traffic cop for speeding outside Orlando, FL, the deputy claimed to smell marijuana and searched the car. No drugs were found, but the deputy did spot an Xbox and eight games and seized them from Hillman, alleging they might have been stolen.

WFTV:


"He said, 'When you got your receipt and box and we'll meet someplace, you show me your receipt and I'll give you your game.' I didn't understand them," Hillman said.



The deputy ran the serial numbers and it did not come up as stolen, but he took the game system anyway. He told Hillman he wanted to make sure no one reported it stolen. Deputies told Eyewitness News there had been a lot of burglaries in the area and Xbox systems are hot.



Hillman then took his empty box and receipt to the sheriff's office to get his Xbox, but no one was able to find it.



"They said, 'We don't know what is going on. It was no arrest, no police file, no case. We can't find it,'" Hillman said.

Geez, the Xbox never made it to the evidence room... I wonder what could have happened to it.

There was no report of a person matching his description having stole an Xbox. The officer even ran the serial numbers, and the Xbox did not come back as having been stolen. How is this not a crime? Depending on the particular Xbox version and the 8 games he had with it, it could easily exceed $500 making this a felony. You can't just take someone's property 'to make sure no one reported it stolen.' The officer had the man's name/contact information and the serial number. Should it be reported stolen in the future he had everything he needed to find the guy and retrieve the property.


Worse, the guy shows up with the box and the receipt and the Xbox isn't in the evidence room?!? I mean C'mon! How crooked can you get! BS!

This man should have known his rights. The cop would have never been allowed to search his car if he hadn't been smoking marijuana. The reek of weed in his car gave the cop the right to search the vehicle and take the XBOX 360. In most cases that Xbox will never make it to the evidence room. Just another crime perpetuated against the minorities of society.

I'm sorry to say CaptainCaveMan, but I;m sure my rfid chip will take care of, all of that, and I won't need all that paper.

And when those cops get a repremand for disposing of all that weed and coke out the back door of lock up. It's a real pity, they were only doing, their patroitic duty. So what if people like me think these great cops should be put under the prisons.

Ok... so It's Illegal to be high in Florida? (I saw the cnn report , he didn't look high to me)... The cop pulled them over for speeding. This story smells... I'll tell you why I think so.

#1 He smelled Marijuana in the car and found nothing? (probable cause , which would allow him to check the car for contraband or drugs)

#2 There weren't any open warrants on them. (they would have been disclosed after the DL's were run into the computer)

#3 They obviously were not belligerent towards the officer , because there were no arrests or detentions made and the officer had not even finished or submitted any type of report before the end of shift.

#4 Had the officer had even an inkling of a crime commited he would have radioed a supervisor or tour commander and get his input.

This is shoddy police work at best and an attempt to defraud this man out of his property through (theft by deception) at worst. If this was on the up and up and I had pulled him over , to cover my A$$ I'd want to make sure a second officer was there that could verify what Items I took. (the guy could say "I had 50 XBOX games that he took , I know I only have the reciept for these five but I had used ones I was going to trade in") this is what scumbags and real criminals do... they're "get over artists" Now It's your word vs his word , you have no report written , no officer to vouch for you and you're riding around in your cruiser with "stolen" property , and a pending interview with IAB. The victim filed no formal complaint with the department , from the evidence presented it seems he just wanted his stuff back... anyone else have a diff spin on this?

You are very right. We are all quick to call cops the "bad" guys and judge them as monsters. What we forget is that they have lives and families to. They need to live and provide for their families just like us. Cops are told to act such a way, or rather they are conditioned into believing that their actions are helping society. Instead of blaming the cops we should blame the PTB that made them that way.

Prior to moving a couple months ago, I lived in Orlando for ~22years; Pine Hills is no South Central. Look up the crime and murder rates (not to mention the population size) and get back to me.

Further, his "highness" has no bearing on whether or not this was an illegal search and seizure. It was illegal and improper, period Otherwise, how would you justify this officer's seizure of this young man's property? So from now on, if anyone lives in an area where X is being stolen on a frequent basis, and a citizen happens to be in possession of X, but doesn't have their receipt on them, the authorities have the right to seize the property until such time as the citizen shows up with proof of ownership and the property can be 'found'? (oh, and, sure it's in his car with the half finished paperwork not plugged into his t.v. at home. riiiight )

Is that how you justify this? What you doing after ATS today, Gestapo Club meeting?

The problem is that cops in OC Florida or South Central LA do NOT have the right to move on property without any evidence or reason. Being high & black with dreads doesn't fit the description of "probably cause" I think the cop just wanted an XBOX and/or is just enforcing his own version of the law.

I'm sorry folks, yes we need to have compassion for police, but not when they over step their boundaries. That's when we need to be the most resolute or be pinned under further oppression.

Is the cop an expert in what marijuana smells like? Is he certified to sniff out marijuana?

Kinda reminds me of this thread I once posted. A lawyer ask state trooper to sniff out marijuana to prove they can find marijuana.

Let them call the drug sniffing dogs if your innocent so there are witnesses.


This won't stop them. I know about some cops who use to drop something in the car so that the dogs could find. Let's just say if you had the right money you could get your enemies busted pretty quick.
