Good question, Jess! Truth is, we really don't know. I suspect that she
deliberately defied au6th6or6ity, (I gotta LOVE anyone who does), and
then found out what happens if ya do!

Anyway, now the girl has a "criminal record" which will follow her for life.
AND, any U.S. citizen charged with a crime, gets an automatic FBI file
started about them, for life...that's how an evil fascist police state works.

What does it matter if the books were checked out or not? Its theft when you dont return them. This is what the law means when it says RETAINS possesion of library material. To retain possesion you must have borrowed it with concent first.


First she took and carried away (checked them out) with concent - legal

Then she retained them with concent - legal

She failed to deliver them at the agreed time, so she was told to deliver them or else... but she retained them - illegal


My education in law is limited, but this seems pretty straight forward.

Woman embarrassed, angry over library book arrest

An Independence woman charged with theft for failing to return a library book said Friday she is both embarrassed and angered by the arrest.

“I do think it’s extreme going to jail over a library book,” Shelly Koontz, who underwent fingerprinting and mug-shooting during her booking Thursday night at the Buchanan County Jail, told The Gazette.

Independence police arrested Koontz at her home about 8:30 p.m. on a warrant charging her with fifth-degree theft, a misdemeanor, for not returning the “The Freedom Writers Diary.” She had checked the book out of the Jesup Public Library in April.



You will note in this example, the woman was apparently directly charged with theft.
