Will he be charged? Maybe. Will he be convicted, not a chance. That's why the laws are in place, to keep it from the free for all that other countries have. Not pointing any fingers. Btw, notice that firearms were also not used.


That being said, my father, that did his stint in the RCMP, always said, "It's better to be judged by 12 than carried by 6." Someone breaks into my place they'll be met with force, firearm not required and I'll go before that jury feeling pretty good.

I remember once in my younger party days. Myself and a buddy got pretty drunk.....it got late and we called his girlfriend to pick us up. she got us and we drove back to his place (I had been there before) i fell asleep on the drive back , the problem comes in when they decided to let me continue to sleep in the car instead of waking me up and taking me upstairs. I need more details, darnit!

The way I understand our law is that as long as you didn't intend to kill them and you only used 'enough force to necessary' to defend yourself, you're fine. Enough force necessary is the important part here - if he stabbed the guy repeatedly while in a struggle with the two, that's reasonable force. If he kept stabbing him after the guy was down, he's not really defending himself anymore in the eyes of the law.

I am in Canada and the courts are nuts- there is more protection and right for protagonists than victims
the rcmp do more counseling than enforcing in my experience and they have a poor pr lately in canada with tazor and abandonment deaths- they always investigate their own misdemeanors lol
the mounties get their man should be changed to the mounties get their pension - a lot of unsolved crime that no reporter cares to bring up - that is if there are any real reporters left

I have dealt with crazys round here for years and been harrassed and attacked a couple of times by dopers and drinkers because I stand up to them - I am also a senior and these bimbos are half may age
...and the cops are pissed because I used bear spray on them twice and asked me to avoid walking my dog past their dope house - I said OK , if you cops stay away from our road because you make the grow ops nervous
- took them 20 years to actually get around to doing a raid and then busted into two wrong houses! what a joke - nice 4 bye and helicopters and good pr paper splash with some maryjane plants in the back of their pick me up
.............but no convictions because the grow was on crown land


I have pictures of injuries from an attack - the court would not prosecute
these low life leeches who know how to use the social services and court system for their own ends -go figure
We work and pay taxes so the govt can call the sucks troubled clients and protect them with no accountability

..and gun control here has been a major money suck by the beurocrats who want pics and promises law abiding gun owners
I could say more but I am glad I am not them - what a lot of $+it because of liberal socialism from Berkley in the 60 's that the dumb canuks sucked up

I too am an Alberta resident...

There is always an investigation in cases like these. There is no way this guy will be charged. Even if he is charged the Canadian legal system is so lax this guy would never do time. Real criminals in canada are hardly punished.

The press makes statements like these to stir up a story, gets the old people calling into talk radio.

your lucky u dont live here in the UK we aint allowed to do anything, only the other week a guy was in the paper for pushing a burgular out of his bedroom window and they wanna confiscate his house to pay for damages to the burgular, the cops even told me if my beast of a german sheperd bit a burgular they would push to have her put down and then sue me, so now we keep 2 baseball bats with a ball one in the house and one in the car incase we need them, u guys can buy guns we cant here unless were farmers and want shotguns u get caught with a handgun its 2-5 years no questions asked, there even banning softball air guns now, the shops online cant sell to you unless its face to face, if i was u lot id get your guns now before march when i reckon they will change your laws so anyone with a speeding ticket is classed a risk and cant have a gun...lol

Possible motive for attack.

The guy has every right to defend himself and his home regardless of the reason for the intruder being there.

You can't possibly expect someone who is fighting for their own life to think about preserving the life of their attacker.

Strange case. Will have to wait for the facts to come out before jumping the gun.

I think this is horrible that this man could possibly be incarcerated just because he was protecting his family / home. I mean, what do they expect Canadians to do if your home is burglurized and faced with a life and death situation, i.e.( kill or be killed). I dont think there is any other choice if you or your family is going to be harmed or end up dead even then again, I am from Texas, but, does that really matter, its human life, survival.... I wonder how things would go if some of those people up in office (i.e. the lawmakers etc.) were faced with the same situation to protect themselves or their children from a possible killer breaking into your home to steal and do harm:

"Oh excuse me sir, I see you have just entered, i mean, broke into my residence without my permission, do you mind if i have a moment of your time?"

Burglar:"Certainly, do you mind if I hold a gun to your head?"

"Well, kind sir, I dont think thats very nice of you, do you mind not shooting me and putting the gun away real fast, lets settle this like real men, hang on while i go get the wiffle bats!"

An awful lot of people expect the victim to just give in and be victimized or murdered. A battered and raped corpse with no criminal to be found is always morally superior to the still alive and well armed defender standing above a dead attacker. My girlfriend is battling to find sense of this logic in her head right now as it is illegal to be armed in the park near her home where she walks her dog in the early AM and late PM. The park is a "gun-free" zone. Somebody should notify the muggers/rapists/murderers that they would be breaking a law should they enter the park armed. Maybe nobody told Cho V-Tech was a "gun-free" zone?
You go through all this BS to get a permit to carry for the sole purpose of defense because by walking the dog before and after work you're in harms way only to have the city government tell you you aren't allowed to carry in the area you specifically sought to carry in.

More victims=more political opportunity.

Again, I must reiterate.

I would make sure the attacker would NOT be getting back up. I would not take the chance of thinking the attacker was disabled only to have him pop back up and do more damage.

I don't know all the details in this case, and I am not a Rambo want to be either, I just wouldn't take any chances with my family's safety.

I myself, would expect no repercussions from my actions if this were the case.

i'm from vancouver, canada and have to say i absolutely agree with all the american’s on here saying that canada is a small retarded child when it comes to laws in property invasion. we obviously haven't gotten to the point of time travel or physic intervention and trying to swing for concussion rather than fatal blow at 3 in the morning sounds a little crazy. it seems like you're better off being the one on the other end of the bat in some cases.
the cops in this country and others shoot to kill in the worst times imaginable and anyone protecting their families and belongings could face jail time and a criminal record?
i bet if a cop was sleeping tight and was woke by burglars, shot them dead, he'd get another star.

From what I've heard, the fight started in the upstairs bedroom. The body was found at the foot of the stairs. This could suggest to the police that the guy was fleeing and was chased down and killed. If that's the case, according to Canadian laws it isn't self-defense.
