Well, if you can't do the time, don't do the crime.

The guy had a previous criminal record, then he went and stole something else and assaulted the clerk. Doesn't matter if it's a donut or not. Theft is theft, assault is assault and if he wanted a donut so bad maybe he should have paid for it.

I have zero sympathy for the dork.

It's up to 15 years.

If he had just taken the donut and ran he wouldn't have to worry about prison time. But he decided to get physical which bumped it up to a felony. Sucks to be a moron.

Yeah, he's looking at jail time for the assault, not the theft.

I'm just glad there weren't any tazer-wielding cops around, or they would have roasted this doughnut thief alive...

Whenever you look at an offence, under statute it will carry a maximum penalty so perhaps this incident just has a potential to warrant the 15 years. I think it is media hype.

It will be up to the court to decide the penalty in line with the legislation.

At least this one has not died in custody for stealing a packet of pencils and a colouring book!!

If he gets a lawyer he might be able to plea bargain it down to a lesser offense. What happened to him is a prime example of the misuse of the "three strikes" law. Judges should be allowed more discretion in applying this law.
