President George W. Bush lacks the power to order the military to seize and indefinitely detain a Qatari national and suspected al Qaeda operative who is the only person being held in the United States as an "enemy combatant," a U.S. appeals court ruled on Monday.

After September 11, a lot of things changed and new knee-jerk laws were put into place. If the US had suddenly become as dangerous as Israel, maybe some of those provisions would have been justified. But as it is, we frankly don't seem to need these laws, and it is about time for the pendulum to swing back in the other direction and move us towards a more logical and restrained equilibrium.
