ATLANTA, Georgia (AP) -- A police officer and a former officer pleaded guilty Thursday to manslaughter in the shooting death of a 92-year-old woman during a botched drug raid last fall. Another officer still faces charges in the woman's death.

Officer J.R. Smith told the judge Thursday that he regretted what had happened.

"I'm sorry," the 35-year-old said, his voice barely audible. He pleaded guilty to manslaughter, violation of oath, criminal solicitation, making false statements and perjury, which was based on untrue claims in a warrant.

With stories such as this I often remember the once brilliant idea known as the 4th amendment, mainly;

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

I love how our government, or in this case several ignoranus cops step all over the 4th amendment to go searching for some "narcotics." and end up finding a bag of weed instead.

Congratulations cops, you not only killed a 92 year old woman
but you also help to kill the 4th amendment. Congratulations America the year is 1984.

This type of behaviour is exactly what the 4th amendment was trying to stop but in todays America big business and government are the only ones with the voice hence the reason why they can say whatever and do whatever to whoever they want. Stories like this happen everyday in this country however the only difference with this story is the lady killed was 92.

The sooner you realize that individuals have no more rights in the US the better off you will be. The US Government/Big Business have grown so large that they have become what they have always hated, socialist. Well, cheers and have a nice day!

I have not been here for a while, for various reasons.
I actually came here to see what was being made of this story.
I remember some were defending the police.. Some made a big deal about she having hit the cops that burst through her door 5 times.
No one is saying anything now.
And it turns out, that this 92 year old woman, cut down like a dog in her own home, only managed to get off one shot...
The police were shot by their own fellow officers, further more, the marijuana was planted.

Ten dollars and my Brother's left testicle they wont go to jail. Thats the system. There will be a commission of some sort or some superficial response and the cops will get off the hook. Procedural/Departmental error and 'some tip off' that was wrong.

This is indeed a sad story, 92 and killed defending herself from authorities who are mean't to serve and protect.

It takes an extraordinary person to be a good cop, unfortunately alot of those doing the job are underqualified.

I'm all for most of what's said in this thread but how do you equate two police officers being arrested and charged for their illegal behaviour in breaking the 4th amendment rights of this woman with the 4th amendment being no longer valid?

If it was no longer valid, and enforced, then why are these degenerates being charged?

The harshest punishment given was for 12 years!

If me and a group of my friends broke down someone's door, shot them to death repeatedly, then attempted to sprinkle crack on them, I'd be charged with murder, and there'd be nothing I could dummy it down to. I'd be screwed, and facing 25 to life. Why do they get off with murdering an old woman in cold blood? Because they're cops.

And people wonder why people don't trust the police.

Its cases like this, that causes a mistrust of police. They should have gotten more than 12yrs but if they do actually serve jail time they will have to be in protective custody for obvious reasons. Ohterwise they wouldnt survive the jail term

Home invasions that end in death usually end up with pretty stiff sentences. These officers used their position in law enforcement to obtain an illegal document that allowed them to bring multiple guns into someones home. Just like asking your crew to help you.

Then, they emptied their clips, killing the woman, and putting other officers in danger. They, they made a distinct attempt to cover up the murder.

First Degree Murder

MURDER, FIRST DEGREE - In order for someone to be found guilty of first degree murder the government must prove that the person killed another person; the person killed the other person with malice aforethought; and the killing was premeditated.

To kill with malice aforethought means to kill either deliberately and intentionally or recklessly with extreme disregard for human life.

Premeditation means with planning or deliberation. The amount of time needed for premeditation of a killing depends on the person and the circumstances. It must be long enough, after forming the intent to kill, for the killer to have been fully conscious of the intent and to have considered the killing.

First-degree murder in California includes a killing that is "willful, deliberate, and premeditated," or that is committed in the perpetration, or attempt to perpetrate, certain felonies, including burglary, and not including the petty offense of shoplifting. Cal. Penal Code S 189.


They could be convicted of first degree murder if the prosecutor tried.

Just further proof that cops are demi-gods to the system. But hey, what kind of system would you have if your jackboots got thrown in prison every time they killed someone? Who would man the impending police state?
