I can't argue with the absence of due process here, but it was clearly rescinded/dismissed, post 9-11, in cases involving
National Security.

Officials there detained him while investigating his claim. Benatta's background -- an Algerian Muslim and an avionics technician without proper
immigration papers -- prompted Canada to turn him over to the United States after the terrorist attacks.
He was obviously detained for legitimate reasons, and I think it's fair to say he would have at least
been aware of the attacks by the time he
was returned to US custody.
I am in no way attempting to divert focus from the core issues surrounding this situation, but I do feel the thread author has presented it with
several unsubstantiated and baseless assertions.
