COLUMBUS, Ohio -- A man imprisoned for writing fictitious stories of child torture and molestation has been released from jail two months after an appeals court threw out his child pornography conviction.

Brian Dalton was on house arrest Friday at his parents' home in Lancaster, about 25 miles southeast of Columbus. He can have no contact with children under the terms of his release.

That depends on the context of the book. What sort of book is it? Are the child torture/rape parts small partd of the plot, like, a book about a group of devil worshippers, with a sidetrack on thier activities, or what?

Id need to know the entire context of the book. If it was simply a bunch of short stories of graphic sex with kids, then yes, it would be childporn, but of the book was simply a large novel with these things as smaller parts of the plot, then no, its not kiddie porn.

but they do not give us this information.

Good question. The story doesn't give a clue as to the context of the stories. Obviously it was something he showed somebody or he would never have gotten busted. Maybe something he put on the web?

Hey well #, I know this sucks ass what I'm about to say, and I don't agree with it, but it's how things go. They can't really get him for anything until something happens. I remember a biker guy used to speed up and down our street, and someone called the cops on him, and about half the people from the neighborhood were outside telling the cops how the biker would always speed. But the cops couldn't do anything until he gets caught or something bad happens.

There's no proof that he actually molested a child, only just text from the book. Maybe police can keep an eye on him, but they can't really take away any of his freedoms for writing a book.

While I don't approve of it...just writing stories about it doesn't make him guilty of it... How many porn stories are of rape, or incest? How many porn fantasies involve the old schoolgirl/teacher bit, etc.? You can't just jail someone for writing taboo.... Obviously, taboo sells in porn. Personally, I'd rather someone with those inclinations get off reading a book, than looking at ACTUAL kiddie porn...or worse ACTING on it!

Certainly isn't my cup of tea, and he sounds like a sick #, but the moment you start locking up people for fiction, you might as well just surrender at the door....

Does this mean murder mystery writers should be watched by police, or not be allowed near knives? This is what it would lead to, once you go down this road...

And how long do you think it will be before that person switches from reading to actually doing it.Child molestors are not into it for the sex.They love it because the child is helpless against them.There is no room in my society for this crap!And if I find out someone is writing it that I know or live near,forget the law,I will beat the living # out of them till they beg me to kill them.

By this reasoning, how long do you think it will be before a murder mystery writer goes on a killing spree?

Do I approve of it? Hell no! Do I approve of his right to write it, or the right of some sick puppy to read it? Well, they have the right to read what they want, as long as it isn't infringing on the rights of others....

My point is, you can't start down the road of convicting people for crimes they just WRITE about. This would simply set a dangerous precedent. Next, we'd all be convicted of subversion, for bad-mouthing the government!!!
I think you see where I'm going with this.....

I do see your point Gazrok.But pornography is illegal in most states.There are loop holes but for the most part it is not legal.Children are helpless people who we are supposed to protect.Writing fantasies of sexual relations with them is just way over the line.Freedoms are something earned not a right.We can not allow this kinda crap in our society.I am all for the free speech ammendmant,but there have to be boundaries.
Sex is legal,so should it be legal to have sex with a child?NO!You have to have a clear line of where freedoms start and stop,or there will be no limits to anything.I think you can see where I am going with THIS.
