I hear this theory a lot--that Trump's legal team isn't presenting its evidence because it doesn't want to tip its hand, or because it's saving the evidence for the supreme court. That is not how our legal system works.

Appellate courts in this country, including the Supreme Court, generally do not hear new evidence; appellate courts are limited to reviewing the evidentiary record established in the trial court. If a party does not raise certain evidence in the trial court, that evidence is generally considered waived and will be unavailable to present on appeal, including in the Supreme Court.

Moreover, when alleging fraud, parties have to allege fraud "with particularity" (see Federal Rule of Civil Procedure 9(b)). That generally means that, when presenting their opening complaint in the trial court, parties must specifically allege the "who, what, when, where" of the fraud and put forth enough specific facts about said fraud for the court to determine that it plausibly occurred. And even when not alleging fraud, parties still must put forth enough specific facts about the illegal acts that they are alleging for the court to determine that those acts plausibly occurred. If parties do not meet this bar, their case will be dismissed, and they will not be able to put forward new facts or evidence on appeal.

Parties simply do not and cannot withhold the facts and evidence of their claims at the outset and expect an appellate court to consider those facts and evidence later. If Trump's legal team had any smoking-gun evidence (or any evidence at all), it would have put such evidence forward already because those lawyers are well aware that they will not be able to put forward that evidence later.

I always felt it was odd, threw out all his appearances (not that he had many). He basically told people to vote for Trump, not him, he doesn't need them etc etc etc. He gave the appearance that he does not want or need their votes. The general population knew, the left would try cheat by mail and use the virus to maximum potential.

The guy that gets suburban moms in 12 cars at his rallies using the Wuhan Virus excuse as to why he has very little support. I highly doubt Kamala/Biden would turn down 12k+ people if they were available at his rallies. Let alone the massive support that Trump has.
