Turns out it wasn't and he got his girlfriend killed.

But to answer your question..If they come too hard then they still need to prove it and if not they can't just drop back down to a lower charge. This is why in the case of Floyd it will be very hard to get anything outside of a OJ type verdict since the charge they gave means the cop had premeditated reasons to kill him and if they can not prove the premeditated part then the cop walks even though he should have been tried on a lessor stickable charge.

It's a catch 22 if they get charged with a higher crime they likely get off easily. Shouldn't forensics be able to determine if the guy shot through the door or not? Among other things, I'm pretty sure there was illegal crap going down there.It doesn't mean the police might have used a little more restraint. It's an apartment building forget the occupants of that apartment with bullets flying you could kill people next door or above and below. I want to catch the crooks too,but not sure thats the way to do this.
