I think it should be double penalty hate crime due to the real social harm this does.

If I hate someone who is same "race" as me and I light his or her car on fire it's not as bad as if he or her were a different "race" and I would do less jail and/or prison time because it would just be felony arson or whatever minus the hate crime charge although I did hate him or her.
