Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.


That's the Posse Comitatus Act. Simply having military bases isn't in violation of the law. The second you start using those troops to enforce the law however, you are in violation.

The circumstances of their application for asylum does not matter. As long as they submit it within a year of being on US soil, they're here legally. At least until a judgment is made on their petition.

so how prey tell does the coast guard get around such?
it can be done, if the threat were shown to exist
the 2 examples I sited earlier would be more than enough justification

The Posse Comitatus Act is only in effect for the Army and was amended for the AF. Other branches are not part of it though most have something added to their rules.

The Coast Guard is also now part of DHS and is totally removed and was never included.

There are also other exclusions as well as changes that have been made and reverted over the years.
