All ships and aircraft have the right of passage as long as they are outside of territorial air or waters, as long as they are not directly involved in active operations against said nation. So unless they're launching an attack on Iran, they have the right to be there without being shot at or seized.

That is probably what the Iranian operation against Kurds is all about. The only way Iran can claim to be on the offensive against a group sponsored and protected by the Yanks, British and Israeli's
