Jussie Smollett Update: Texts, Emails Reveal Foxx Asked Johnson to Turn Investigation Over to FBI
New documents showing text messages and email chains revealed Cook County State's Attorney Kim Foxx's asked Supt. Eddie Johnson to turn the Jussie Smollett investigation over to the FBI before she recused herself from the case.
The documents, obtained Wednesday by NBC 5 via a Freedom of Information Act request, show correspondence between Foxx, an unknown person and Tina Tchen, a one-time assistant to former President Barack Obama and Chief of Staff to Michelle Obama.
In an email, Tchen said she knows the Smollett family and said they "have concerns about the investigation" into his alleged hate crime attack, which police now say was hoax staged to boost his career.

Depending on the dates of the correspondence, she may have been pushing for the FBI because she actually thought the case had merit... getting the FBI involved would be the icing on the cake politically. Can't have a hate crime of that magnitude being prosecuted by local cops.
Of course, it doesn't say much about her intelligence if she thought the case made a lick of sense, but that is another discussion.

Geragos raised questions on his âReasonable Doubtâ podcast about what happened while the brothers were in custody.
âDid you charge them? Did you give them immunity? Did you do anything with them?â he asked. âYou said they changed their story in the 48th hour â why did they change their story? Was it lawyer-driven?â
A person with knowledge of internal discussions among Smollettâs defense team told TheWrap that they believe the brothers made a last-minute deal to avoid charges.
Gloria Schmidt, an attorney for the brothers, did not immediately respond to a request for comment.
Geragos said police had a stronger case against the brothers than against Smollett. âI have not seen anything that supports this idea or the narrative that they put out there that he was in cahoots with anyone. They have a whale of a case against the two guys â the two brothers â but thatâs it,â he said.
Los Angeles-based criminal defense attorney Lou Shapiro, who is not involved in the case, said Smollettâs team can argue that any deal casts doubt on the brothersâ credibility.
âClearly some deal was struck, or some promise was made to them to tell the story and maybe it was a coerced confession in some way,â Shapiro said. âMaybe it wasnât a deal, maybe they just felt so coerced and pressured that they had to tell the story just to get out, right? Thatâs another angle.â
