The Clinton and Trump families were very good friends at one time. Perhaps they still are. You and I certainly don't know for sure.

So are you saying you think Trump talked Baker out of criminal charges? You think Trump was in a position to give Baker his marching orders? And that Trump wanted to clear Hillary?

I’m merely pointing out that the OP conveniently left out yet another admission that the FBI determined they couldn’t prove intent. Unless there’s some new revelation that moves the needle past that point, this is never going anywhere.

I believe the phrase in the statute is “gross negligence,” a phrase which Comey was instructed to replace with a euphemism in the final version of the report. That’s troubling to me: the very phrase that would indict her was removed at the last minute. Weird.

Comey being instructed to replace that phrase is troubling.

And while I'm not a lawyer (but did stay in a Holiday Inn once), I remember the concept of 'mens rea' (guilty mind) being discussed in a criminal law class in college. It essentially refers to the intention or knowledge of wrongdoing, rather than the actions of a crime. In this case, I'm not sure what led them to think they couldn't establish that, but it is something they consider.

Sure, but I’m pretty sure when you sign your SF-86 you acknowledge that you’re responsible for securing sensitive information. In other words, you’re waiving your ability to claim “I didn’t know any better.” That’s why you’re granted a clearance. You’re accepting responsibility for what happens to info in your custody. Seems to me mens rea doesn’t really apply. But I’m not a lawyer either.
