Tbh though, it is pretty rare for a first time low felony offender to get actual jail time. BUT, considering the magnitude of his planning and the massive amount of resources wasted I'm not so sure the judge will go so easy on him. Keep an eye out for those federal charges though.

Jussie Smollett has been Indicted by a Federal Grand Jury


It’s official: Empire star Jussie Smollett has been indicted by a Chicago grand jury and faces a felony charge for filing a false police report in connection with his alleged attack last month.

Earlier Wednesday, Chicago police announced that the actor was now officially classified a suspect in a criminal investigation for filing a false police report, which is a Class 4 felony. A Cook County grand jury returned an indictment later today, according to The Advocate, and Smollett now faces a maximum of three years in prison if found guilty.

Chicago authorities are currently contacting Smollett’s legal team to “negotiate a reasonable surrender for his arrest”; the actor is expected in court on Thursday.

What About Harmless, Suspicious White Powder?

Turns out, there's a handy federal offense covering this sort of thing. 18 U.S.C. section 1038 makes it a crime to "engag[e] in any conduct with intent to convey false or misleading information [that] may reasonably be believed [to indicate] that" a biological agent is present. It also makes doing so a civil action, i.e. allows someone to sue.

Which is lawyer-talk for: no, you can't send threatening letters and add sugar, flour -- or corn starch -- to make it legal.


Is It a Crime to Mail White Powder Even If It's Harmless?

So, as far as the powder goes:


(a) Criminal Violation.—
(1)In general.—Whoever engages in any conduct with intent to convey false or misleading information under circumstances where such information may reasonably be believed and where such information indicates that an activity has taken, is taking, or will take place that would constitute a violation of chapter 2, 10, 11B, 39, 40, 44, 111, or 113B of this title, section 236 of the Atomic Energy Act of 1954 (42 U.S.C. 2284), or section 46502, the second sentence of section 46504, section 46505(b)(3) or (c), section 46506 if homicide or attempted homicide is involved, or section 60123(b) of title 49, shall—
(A) be fined under this title or imprisoned not more than 5 years, or both;
(B) if serious bodily injury results, be fined under this title or imprisoned not more than 20 years, or both; and
(C) if death results, be fined under this title or imprisoned for any number of years up to life, or both.

He could face up to 5 years.

In regards to the threatening letter itself"


(b) Whoever, with intent to extort from any person any money or other thing of value, so deposits, or causes to be delivered, as aforesaid, any communication containing any threat to kidnap any person or any threat to injure the person of the addressee or of another, shall be fined under this title or imprisoned not more than twenty years, or both.


18 U.S. Code § 876. Mailing threatening communications

I could see a death threat as falling under the, "any threat to injure," descriptor from the above excerpt, thus another possible 20 years.

In an interview with "Good Morning America" on Wednesday, "Empire" co-star Terrence Howard said a production manager notified the cast about the attack in a meeting on set Tuesday.


The actor said Fox boosted security on set in the wake of the incident and offered each cast member 24-hour personal security.

"It was offered up today that we could have 24-hour security. Someone parked in front of our house during the evening, someone to drive us, or to follow us to and from work," Howard told "GMA."

"Unfortunately, without Fox paying for that, that's about $1,200 a day worth of security," he added. "It makes it hard for people not to want to think about going and just getting a license to carry a concealed weapon because it would be much cheaper, but then what does that say about our country?"



This was either a publicity stunt gone awry, a nutjob (Smollett) on the brink, or a political ploy by somebody.

He should get the full weight of the law, imo. Enough is enough.

CHICAGO (CBS) — The two brothers involved in the Jussie Smollett attack told police that Smollett was behind creating a racist letter that was sent to the actor on the set of his show, “Empire,” according to two sources with first-hand knowledge of the investigation.

And when that letter did not get a “bigger reaction,” Smollett orchestrated the attack a week later with the two men–Ola and Abel Osundairo, sources said. Also Tuesday, sources said the two brothers were seen on a ride share video camera before being dropped off near the location of the attack.

I was looking into that myself and found an interesting article. Apparently the feds dont take to kindly to that because it takes up %60 of the FBI's WMD divisions time.

On June 4, 2009, Goyette was sentenced to 46 months in federal prison after pleading guilty to two counts of making a threat and perpetrating a hoax. He was also ordered to pay about $88,000 in restitution to fire departments, hazardous materials teams, and other responders. Coincidentally, the judge who ruled in the case had herself been the target of a white powder letter in 2002, sent by a prison inmate that she had sentenced previously. All that letter did was earn the inmate some additional years in prison.

I was thinking that although it was aspirin and not anthrax, that it would carry a more severe charge than just sending a letter with no powder. He really screwed the pooch on this one. If you're sentenced to over 1 year in a Federal prison, you will have to do at least 85% of your time.

Has anyone else came to the conclusion that.......he may not have thought this one through all the way?
