According to the Special Counsel Bot on Twitter, the indictment was posted no later than 6:14am: twitter.com...

That's before the CNN reporter texted the indictment to Stone's lawyer, linking to the SCO's website at 6:22am.

There is no evidence that CNN had the indictment before it was publicly released.

You can read why they say they took the gamble of sending a producer and camera operator here: www.cnn.com...

But what they say doesn't really matter. What matters is that the data, as provided by Stone's lawyers, doesn't show in any way that CNN had a copy of the indictment before it was publically available. The suggestion that CNN showing up ahead of time must mean they were provided the indictment before it was unsealed, and there are no other possible explanations, is ludacris.

According to the motion, the clerk’s office “informed counsel for Mr. Stone that the Indictment’s entry into the docket was made on January 25 at 8:55 a.m., more than two- and-a-half-hours after the news reporter sent the “draft” Indictment to counsel, and four hours after the news organization’s camera crew arrived at Mr. Stone’s house to film his arrest on the sealed Indictment.”




Based on this new evidence, Stone’s attorney’s contend his arrest on Jan. 25, was staged for the CNN crew, which was ready to film the arrest and that someone in the Special Counsel’s office leaked the information.




“The copy of the unsigned indictment provided by the reporter appears to have come from the Special Counsel’s Office,” according to the motion. In the Exhibit 2 document the metadata shows the signatures of AAW. According to the metadata on the “draft” indictment provided by a reporter while Stone was being arrested, established that it came from an “AAW” author or computer. That a member of the Special Counsel’s office has the initials “AAW,” supports a reasonable inference that that office is responsible for the unlawful public disclosure of a grand jury document sealed by order of the Court.”

If you recall, in late January Senator Lindsey Graham sent a three-page letter to the FBI asking them to explain why the raid was so heavy-handed and why CNN arrive 1 hour ahead of time. The FBI had until February 5th to respond. As far as I can tell, they never did respond.

I would love to see their response.
I am not aware one was given.
Sara Carter is a pretty good reporter. Looks like AAW is in trouble again. Perhaps he will become unemployed this time?
