Assange won't sue the Guardian. Such a suit would have to be in England, and there is an outstanding warrant there for bail jumping. He would have to appear in England for depositions and pre-trial proceedings where he would be arrested and held without bail because of his prior bail jumping. He would then be subject to extradition to the US to face possible espionage charges for his leaks. According to reports, a federal grand jury in Alexandria, Virginia issued a sealed indictment for violations of the Espionage Act of 1971. You don't sue someone if it results in criminal charges and potential long-term imprisonment.
