NEWS: Does USFK Curfew Violate the Constitutional Rights of 10,000+ Americans?

The American civilians have been restricted to their homes at night, currently between the hours of 12:00 midnight and 5:00 am by this 4-star general (Laport) and a 3-star (LTG Campbell). Of course, the generals have no legal authority to impose the curfew, on civilians but do have the ability to penalize those who do not abide by it, regardless of the legality. This situation is the very kind the Due Process provision of the 5th Amendment was intended to prevent.

On 29 Dec 2004, a lieutenant placed in charge of the "Courtesy Patrol" at Osan AB, Korea was interviewed on AFN Korea Radio. He said the "Courtesy Patrol" was trying to "scare" people when they found them downtown. This interview took place at approximately 6:03 pm. Apparently the Military Police have never heard of a Terry Stop (from Terry v. Ohio, 392 U.S. 1, 1968).

As of Jan 7, 2005, the Military Police have been advised to back off of their harrassment and abuse tactics by a staff attorney as they are also violating the Constitutional Rights of Americans. This comes after several reports of abuse and injuries being inflicted when the MP's assulted civilians without authority. In conflict with the Eighth Army's characterization that only a few civilians object to the tactics being used; ALL civilians would object to such treatment if asked. Only a few showed the courage to voice their objections. Of course, the MP's are under no obligation to follow the advice of the staff attorney and it is too early to tell whether they will. Bizarre that those who are supposed to be the biggest defenders of the Constitution are here the first violators of it.
