what else should have been done? throw him out of the courtroom? that would just give him a shot at declaring a mistrial. that whole thing about being able to face your accusers. even if it is the sentencing part i suspect he could still go for a mistrial or have his case thrown out of court for rights violations if they kicked him out. i guess they could have stopped the proceedings for the day. but that would be a huge waste of court time and money. not to mention the time wasted on behalf of the poor jurors having the trial constantly delayed, since it would seem this had been a constant and persistent issue. he might even be able to try to get the case thrown out, or a mistrial based on not receiving a speedy trial, if it kept getting delayed. quite possibly his not shutting up was specifically done to try to get the case thrown out of court. really i think gagging him in such a circumstance was more than warranted. but maybe courts need to be provided with ball gags for such circumstances, instead of tape.

All mouths matter.

But duct tapping such is just overkill in the extreme.

No.

The defendant showed no respect to the court or the officers of the court.

I am so sick and tired of the tacit approval to show such disrespect.

White, black, I don't care.

The criminal screwed up.

"The criminal screwed up."

So does the law when it employs duck tapping mouths closed to get on with dispensing justice.

Black, white, purple, pink, don't care either.

This man was in court 50 times?
No wonder the country is broke.
They say a criminal who is their own lawyer has a fool for a client.
I think fool is too generous a term.

Nope.

It wasn't cruel, it wasn't unusual.

It was to shut the criminal up.

The criminal showed the court no respect.

Next time, maybe throat-punch the moron instead of tape.

He saved him from a contempt of court charge.

This is a very insightful response. Not much to add to this comment, but my full endorsement.

Thank you for that kind and thoughtful remark. I've always believed, as a nation, in all ways, we have to behave better, if we can claim to be better, in the world. A pot calling the kettle black is simply a dumb hypocrite. In my lifetime, I've seen a lot of invoking the Founding Fathers and waving plastic flags, made in Communist China (like about everything at Walmart), yet what we do puts a lie to the shining light on a hill concept. We more hide behind, cop to the Founding Fathers or Christianity, which is, in fact, hollow propaganda, for public consumption, to legitimize evil actions, antithetical to very human rights we condemn other nations for violating, as well as antithetical to Christianity. For instance, you can't invoke God, while you're murdering brown people for oil.

The following link is disturbing and asks some serious questions. Incidentally, it's an old list, far from comprehensive, but well makes the point.

Peace.

Why go out of the way, to say that he's black? Race baiting anyone? I used to be a cop, and I don't see anything new here. I've seen this before on white people.

Maybe the judge should've called the cops and filed a noise complaint.

"It wasn't cruel, it wasn't unusual."

That's debatable never mind that the act was more than likely medically unsafe and probably on the wrong side of any health and safety laws.

"It was to shut the criminal up.

The criminal showed the court no respect."

And the judge did by way of his actions?

"Next time, maybe throat-punch the moron instead of tape."

Well if so then a mouthy criminal would probably walk away scotfree and sue the state for a good few million $$$$.

It's the judge's house.

He calls the shots.

He's the boss.

Don't like it? Easy.

Don't commit crimes.

Or they should be throat punched?

That's a crime is it not?

Your advocating assault, should you be gagged?

Shocking , no.

If you're in a court and you continually disregard what the judge is ordering you to do it never never never ends well for you.

I'm not a criminal being sentenced for crimes in front of a judge showing disrespect.

Faux outrage, in my opinion.

"I'm not a criminal being sentenced for crimes in front of a judge showing disrespect."

But if you were then it would somehow be ok to throat punch you into silence?

DBCowboy the world spins, hopefully, you never find yourself under similar circumstance, or if you do then nobody gags or even punches you in the throat to maintain your silence.

I'm not stupid enough to disrespect a judge handing down a sentence.

Totally agree, but when it ends with duct tape something is very wrong indeed.

If the judge had decided that the defendant was looking at him funny should he also have had the tape cover his eyes?

So stupidity equates to being duct tapped where sentencing and judgment are concerned?

You don't see a problem with justice being dispensed in such a fashion?
