Upstate NY, where I live is, quite nice, as well as the Adirondacks...it's too bad our state is run by an arrogant clown. New York's Governor Cuomo, once again, drawing lines in the sand towards hot-button issues. First, it was his stance that extreme conservatives shouldn't be welcomed into the state, then against law abiding gun owners, by enacting the insane NY SAFE ACT, now it's his unwavering support for reproductive rights...specifically for a woman's right for an abortion. If you oppose pro-choice, same sex marriage or restrictive anti-gun laws, then Cuomo is going to get mad. How mad? Well, if the Supreme Court overturns Row vs. Wade, he'll sue them!

“We now need to codify Roe v. Wade, which will actually increase the protections in New York, God forbid they do what they intend to do, which is overturn Roe v. Wade. Because I will sue when the Supreme Court acts, and I want the New York State law in place.”

Guess what if it reverts back to the states MANY states will ban it the second it does. Quite a few states have laws on the books already just waiting for that to happen. Also depending on how the SCOTUS rules it could be illegal in all 50 states by default unless specified by law to be legal.

So the only ones stupid are you and the author of the OPINION article you posted.

Cuomo is pushing for a state constitutional amendment. If Roe V Wade is overturned, and there is enough public outcry, Congress can overrule SCOTUS with a constitutional amendment too. They only problem with that is, a constitutional Amendment has to be approve by a majority, or super majority?, of the states.

That's the same problem with the Republican's have with the 14th Amendment, that says right are afforded to "persons born". To turn that around, we need a constitutional amendment, voted in by the states.

I'm pointing out why the governor of one of the most liberal states in the US would say this. If Roe vs. Wade is overturned, wouldn't his own state enact pro-abortion laws, probably tougher than what's on the federal level? Cuomo is the one who's stupid here...sorry you don't see that.

Don't be fooled. They don't believe Roe v Wade will be overturned. It's just a tool being used to try and scare the pro-choice voters and their representatives into never allowing a firmly conservative SCOTUS as it ruins their progressive plans.

You have to be trolling.

Say that Cuomo could legally sue the SC.if Cuomo wins his case, the SC would appeal and it would move up the court system until the SC hears the case of Cuomo vs the SC.

Before I got on ATS and other social media, I would have said everyone, including Cuomo could guess how that ruling would go, but know I am going with only about 70%. Not sure if that is funny or sad

There is no way SCOTUS can rule that would make abortion illegal. SCOTUS doesn't have the power to legislate.

If after a few years a viable case makes it to SCOTUS and they rule in a manner that over turns Roe than it will be up to the States to make their own decisions. Those conservative states who wish to inaction the strictest rules against abortion will find themselves mired in legal cases. Those states like New York won't miss a beat in their desires.

The likely outcome of Roe being over turned is meaningful and lasting comonsen legislation on abortion. Gone will be the day where politicians can use abortion as a wedge issue against their constituents and we can all move on to solving more difficult problems rather than keep talking about abortion adnosiam... and that is what Cuomo is worried about.

Its pretty sad that so many on the left have such a low opinion of their convictions that they fear their whole world can be turned upside down by one SCOTUS decision. Why do they have such little faith that others might share their convictions?
