It appears this may be just another thread, among many in a long list on the same topic, that seem to forget one very important aspect.

Free speech does not exist. Plain and simple. Each and every one of us have the freedom of speech, but free speech does not exist and we should not confuse the two.

There is a cost to everything. Everything. Nothing is free and speech is no different. While we have the freedom to express ourselves in any way we see fit, that does not mean we are free from the costs of that act. We do not get to push the costs of exercising our right on to other people.

So when I read threads such as this, I am reminded that there are people out there that like to opine about the freedoms they have, but lack the integrity and fortitude to accept the consequences (costs) of using those freedoms and would call those that hold them accountable as being censors.

According to USCourts.gov, the First Amendment does not cover:

Words or actions meant to incite violence or that influence others to commit acts of violence (including “fighting words”) (Schenck v. United States, 249 U.S. 47 (1919))

Libel and slander (New York Times Co v. Sullivan, 376 U.S. 254 (1964))

Child pornography (New York v. Ferber 458 U.S. 747 (1982))

The creation or distribution of obscene materials (Roth v. United States, 354 U.S. 476 (1957))

The burning of draft cards as an anti-war protest (United States v. O’Brien, 391 U.S. 367 (1968))

Students printing articles in a school newspaper over the objections of the school administration (Hazelwood School District v. Kuhlmeier, 484 U.S. 260 (1988))

Students who make obscene speeches at school-sponsored events (Bethel School District #43 v. Fraser, 478 U.S. 675 (1986))

Students who advocate illegal drug use at a school-sponsored event (Morse v. Frederick, 200 U.S. 321 (2007))


So the law has spoken about child pornography and of sharing obscene material...ie the sharing of the abuse of children.

I do find the right and their media are always stepping on a fine line between "Libel and slander" in their posts or stories when they continually post stories unverified, cherry picked information or simply not true to spread propaganda. They continually tell us that the dems, Obama or Clinton have done this and that without any proof to back anything up. The proof they do manage to offer on some things is cherry picked information or from anonymous sources who but use those same tactics against them and they are up in arms, crying about "Libel and Slander".

I like free speech but I also think that there should be repercussions for what you say if they are lies, cause panic and chaos or cause others to commit violence against others.

An example is, if you continually spread the lie that all Muslims are out violent extremists causing some idiot to attack or kill them, then you should be charged with "Words or actions meant to incite violence or that influence others to commit acts of violence (including “fighting words”) (Schenck v. United States, 249 U.S. 47 (1919))". It is absolutely disgusting what the far right can get away with and then these same A-holes act surprised or cheer when a Muslim community or individual is attacked or killed.

Sure the left has those types of idiots who make claims about Christians but the difference is that the majority on the left are intelligent enough to know that those claims are simply not true.

I do not make the claim all on the right do this but I do make the claim that the majority of hate speech comes from that group. This is why so many on the right are so gung ho about free speech, they hate when their hate is infringed upon.
