Yeah, but what if you are not representing your nation? What if you're just a private individual with a lot of money and a big rocket?

My guess is that this is one of those "might makes right" situations. Nobody owns space, but if a country like the US decides you're a threat and gamma ray lasers you out of the sky, there's not a whole lot you can do about it.
