Background: The Affordable Care Act (aka "ObamaCare") financially punishes people for not having the type of health insurance the government approves of...or for not having any at all. In a 5 to 4 decision, the Supreme Court ruled this financial penalty as a legal "TAX", in 2012. The proper name is the "Individual Shared Responsibility Payment".

In 2015, 6.7 million taxpayers paid $3 Billion in penalty-taxes, to help support subsidy payments that enable the lower middle-class afford health insurance, and to sustain Medicaid for the non-working poor and the working-poor. (Individuals who earn under $17,000 @ year.)

The penalty started at $99 per family in 2014, and increased each year. For 2017, it's up to $695 per adult / $395 per child...or 2.5% of 2017 income...whichever is greater.


Now the Good News: Congress is considering removing this Tax-Penalty burden from U.S. citizens, as part of the current Tax-Cut/Reform Bill.

Speaker Paul Ryan (R-Wis.) said on Sunday that repealing ObamaCare's individual mandate is being discussed in talks surrounding the Republican tax-reform plan.

"We have an active conversation with our members and a whole host of ideas on things to add to this bill. And that’s one of the things that’s being discussed," Ryan told Chris Wallace on "Fox News Sunday."

BUT..President Trump has learned (the hard way) that some Republican Senators lose their nerve, when it comes to fulfilling their 7-year promise to dismantle ObamaCare.

Therefore, before leaving for his 12 day trip to Asia, the President directed his attorneys to draft an Executive Order, designed to "defang" the health insurance mandate penalty.

The Trump administration reportedly has prepared an executive order that would effectively gut Obamacare's requirement that most Americans have health insurance — but is holding off on it to see if the repeal of that mandate will be included in the new Republican tax reform bill.

Summary: The U.S. Government's mandate to have "acceptable" health insurance, or pay a significant fine/penalty/tax is one of the most unpopular aspects of the ACA-ObamaCare.

If Congress can't find the nerve (again) to legislatively REPEAL the penalty-tax this year, President Trump will "defang" it. With the President's solution, the god-awful 21 pages of worksheets/instructions for IRS Form 8965 will still need to be completed at tax-filing time by those who don't have "Minimum Essential Coverage". But the bottom-line penalty $$$ amount will be a big beautiful $0 (zero).

If the ACA isn't 100% repealed, you won't be able to avoid Obama's grasp. Two new taxes in the next 2 years will hit everyone who is an employee, or an employer.

None.

The homeless and poor qualify for healthcare at no cost. Therefore they had proof of insurance when and if they filed taxes.

If they don't file a Federal Tax Return, they're sheltered from being fined and imprisoned.

That is incorrect. In some states, like Alabama, there is one insurer and no one gets free insurance. You can qualify for subsidies depending on your income and such but the cost is increasing 36% over last years cost which increased 28% from the year before. Overall Alabama healthcare costs have increased a total of 223%. Everybody pays.

Since this penalty is in the form of a tax, any penalty or punishment you could expect from not paying your taxes applies. Forcing someone to buy something they don't want and/or cant afford and punishing them financially for not buying it is criminal in my book. Its called extortion, racketeering at the very least. Buying this health insurance is akin to buying protection from the mafia.

If they had read ATS, they would have not paid the penalty. The IRS had no system to place to verify if you had, or didn't have, health insurance.

I don't know, I didn't say anything about jail...The IRS can seize any part or all of your refund in order to satisfy your obligation, so if you are poor and you do not sign up and do not pay you can lose income tax return or credit.
