The judge stated that the victim as a drug dealer would most likely have the gun with him much of the time. Certainly explains the lack of DNA, in an alternate universe.

Bag of heroin on the seat: Perp's DNA only.

Handgun supposedly the property of the perp: Cop's DNA only.

But, there was no evidence that the Officer didn't shoot the guy five times at close range, then go to the police vehicle, rummage through a duffel bag, then go to the perp's vehicle where, lo and behold, he finds a weapon with only his DNA on it.

First off, that idiot sealed his fate when he hit the squad car and almost ran over the officers and went on a high speed chase.

Secondly, do you know what a throw away gun is?
Do you think he bought that gun?

He more than likely got it from the hood, and in that case, they wipe it down.

Nobody who touches a throw away gun leaves prints.

And when they use it, they usually have a rag or bandana wrapped around their hand, as to not leave prints or DNA.

So if the gun only had the officers DNA, it wouldn't be that surprising.

Do you have any evidence the gun was a "throwaway"?

Because the evidence we have on the supposedly throwaway gun only had the officers DNA on it. Now remember, this gun is laying on the seat beside the perp who was reaching for it while being shot five times at close range.

So, no blood spatter? Nothing? In what universe does "wiping a gun down" erase all DNA evidence?

Is it more reasonable, based on the facts we have, rather than the supposition you prefer, that the weapon was NOT in the vehicle when the perp was shot?

But, you tell yourself what you need to hear.

Well, since you're bringing up the case, which is completely fair game btw, lets look at what the judge used as grounds for his ruling.

Judge Wilson said he wasn’t convinced after “[a]gonizingly” going over the evidence. He argued that the gun was too large for Stockley to have successfully hidden it from the cameras, and, citing expert witnesses, that the lack of DNA evidence doesn’t mean Smith didn’t own the gun. And he said it would be strange if Smith didn’t have a gun, given that he was believed to be a drug dealer: “Finally, the Court observes, based on its nearly thirty years on the bench, that an urban heroin dealer not in possession of a firearm would be an anomaly.”


I have looked around but can not find what evidence the prosecutors or defense had to declare whom owned said gun.

Wilson wrote, "Stockley does not have anything in either hand during the brief periods his hands are in view on this video, immediately before he exits. The video does not show defendant trying to stealthily recover a revolver and conceal it on his person."

With some 10 city and county police officers standing near Smith's crashed car, a bystander's cellphone video showed police pulling Smith's body from the car shortly before Stockley climbed inside. Stockley testified he found a loaded revolver shoved between the center console and passenger seat. Lab tests of the gun revealed only Stockley's DNA. A plastic bag of heroin seized from the car had Smith's DNA but not Stockley's.


Now, let's visualize this. A car chase for an extended period in which the victim has ample time to retrieve the handgun supposedly on the seat beside him, while he's being chased by police that are yelling and trying to disable his vehicle.

Yet after the Officer Stockley administers the kill-shot, suddenly he needs to rifle through a duffel bag in the police vehicle before he enters the victim's car.

Yet Officer Stockley is ON RECORDING shouting that he was going to kill the suspect.

Yet, the only DNA on the weapon is from the Officer who administered the kill-shot.

Yeah, no evidence of wrong-doing here. Why are these people in St. Louis so upset.

They were discussing it on the news just now with an actual attorney and it made complete sense as to why the judge made his decision.
