No, Obama couldnt stop civil forfeiture with a GOP congress as it was a law. He could direct the DOJ to not prioritize the practice but he could not stop it and now thanks to Trump,GOP congress, and AG Sessions it is back in full swing.


Sounds like Sessions is doing what he promised then - applying the law.
His job is not to apply the law as he sees fit.
The focus should be on Congress.


Sure jump through hoops to justify stupid actions. Pretty par for the course for you and your support of the GOP and for what ever reason I cant imagine why someone from the UK would defend them.

But it isn't, and never has been just about that.

People have lost their family homes over a bag containing a tiny amount of weed, that the homeowner had no part in, just that their son had left somewhere in the house. All of a sudden, the family home, paid for with hard earned money from working all the parents lives so far, and everything they own, their bank accounts, their cars, everything, gone in an instant over less than an eighth of an ounce of weed.

We are talking about people having their car and the money they have on them taken from them, simply because it is now an unwritten rule, that if you have a large amount of cash on you at any given time, you are now AUTOMATICALLY a drug dealer, a gun runner, a sex trafficker or worse, and the cash and the car will be taken from you, at gunpoint if necessary, and if you say a word out of line about it, you go to jail on top of that, and lose access to your bank account into the bargain!

There is NO legitimate cause for a system which can do that to an innocent person, to continue without the people rising up and destroying its enforcement network.

Here is Sessions new policy, it appears to require more burden of proof on the Governments part to show that the assets seized were a result of criminal activity, and it protects property owners from seizure due to others committing criminal activity on/with their property. It also requires the government to pay attorney fees if they lose a court case challenging the asset seizure.

Also for those going on about the Government stealing property... You do know the US Constitution provides leeway for the Government to seize a persons assets, don't you??? So asset seizure 'is' Constitutional.
