NJIB vs, Sebelius which was decided by the SCOTUS in 2012 which agreed with congress ability to mandate coverage as part of its "taxing" privileges also affirmed states ability to reject in this case medicaid expansion without losing existing funds

www.law.cornell.edu...

The same may apply here with the threat of cutting of California because of sanctuary laws etc.

Cut off all out of state water.

Talk about withering pansies.

I assume you are referring to the states allocation from the Colorado river? Because it is the only major out of state source of water.

Also cutting off the flow of the river, would also impact Mexico

That would be the part where I stated as prescribed by law. That ruling doesnt force states to expand medicare / medicaid rolls. That is all it applies to and has no force or effect on anything else.

Whatever. CA provides its own water.

People who have never even been to CA think they are so clever.

No #.

People don't seem to realize California, as a country, has the 6th highest GDP in the world. source
California has lumber, oil, nat gas, rare earth minerals, and water. Plus gobs of food.
Bring it Trump.

I think the more appropriate saying would be bring it California. Its not as simple as the people of California taking a vote to leave. In addition to CA every other state gets to vote as well.

We pay that for a house with between 2700 and 2800 sg ft!! Tons of space, for six people!!! You pay that for one bedroom??? Wow....knew it was bad, but didn't realize how bad!!!

YOU haven't said where you live.

CA is very diverse.

You want to live near the beach? You pay for that.

Other areas depend on what they have to offer.

No, I haven't. It isn't in California, thank God. Never will be, either.

I'm thankful I was born and bred in CA.

I don't have to unlearn anything.

So, you presume that people born elsewhere do? All knowledge only comes from California?? Do tell. *rolls eyes*

It is the left coast.. Most are liberal democrats / socialists who think they are better than everyone else and everyone else is stupid. A simple review of posting history will bear that out.

Very true!! I see the same thing on other forums, too. Recently, one person was claiming that all in "flyover country" - basically the entire United States that isn't a huge city - were ignorant, inbred, racist, lazy, etc. The elitist bias from people like that is beyond ridiculous! Similar comments occur related to anyone Southern, as though half the country is sub-human or something.

Yes, absolutely!

I did not say knowledge. I said unlearn.

So, you presume that all learned anywhere else, in forty-nine other states, is wrong, and needs to be "unlearned"?? Because, gee, California is so capable of doing everything perfectly??

That's funny!!!!

It's a blue state.. They think they can.. The law applies to everyone except them remember. Democrats remind me of the pigs in the book Animal Farm and the constitutional changes they made -

Everyone is equal... but some are more equal than others.

Posse Comitatus does not apply to State guard units. Secondly it was a law passed by Congress and Congress can modify the law at any point.

Glad to hear you are ok with doing away with one of the hallmarks of our country when it is politically expedient. And you guys wonder where the comparisons to Trumpism and authoritarianism comes from. Lol.

" California May Allow Communists to Work Openly in State Government "

" The California State Assembly passed a bill Monday to allow state employees to be communists — a surprise to observers who may have presumed many state employees were already communists.
The bill, AB 22, would amend existing laws — passed, the Sacramento Bee says, “during the ‘Red Scare’ of the 1940s and ’50s” — that allowed state employees to be fired if they were found to be members of the Communist Party.

Moreover, the bill would delete existing section of the state code declaring California’s official opposition to communism. The section of the state code proposed to be deleted states:"

U.S. Constitution, Amendment XIV, Section 3: States...........

"No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or any State, who, having previously taken an oath, as a member of Congress, or as an officer of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof."

I do Believe the State Government in California will All be Arrested for Sedition if they go ahead and Pass this Amendment . WTF is Wrong with these People ?

Maybe you should educate yourself on posse comitatus before trying to lecture on the topic. It is a federal law and only applies to federal military units. Guard units on the other hand answer to the Governor of the respective states and the adjutant general.

State guard units can in fact engage in civilian law enforcement where as federal cannot because of the law.

Got to love clueless liberals who bitch about something they know absolutely nothing about.

Yes yes. It's perfectly fine because it is legal now. I've always loved that circular reasoning. Got any other fallacious gems for me?

Its always been legal. Your the one who is lost on the topic.; As I said educate yourself before trying to argue on the topic.

Posse Comitatus

[Latin, Power of the county.] Referred at Common Law to all males over the age of fifteen on whom a sheriff could call for assistance in preventing any type of civil disorder.

18 USC 1385 - Posse Comitatus Act

Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.
(Added Aug. 10, 1956, ch. 1041, § 18(a), 70A Stat. 626; amended Pub. L. 86–70, § 17(d), June 25, 1959, 73 Stat. 144; Pub. L. 103–322, title XXXIII, § 330016(1)(L), Sept. 13, 1994, 108 Stat. 2147.)

Wiki - Posse Comitatus

The Act only specifically applies to the United States Army and, as amended in 1956, the United States Air Force. While the Act does not explicitly mention the United States Navy and the United States Marine Corps, the Department of the Navy has prescribed regulations that are generally construed to give the Act force with respect to those services as well. The Act does not apply to the Army National Guard and the Air National Guard under state authority from acting in a law enforcement capacity within its home state or in an adjacent state if invited by that state's governor. The United States Coast Guard, which operates under the Department of Homeland Security, is not covered by the Posse Comitatus Act either, primarily because although the Coast Guard is an armed service, it also has both a maritime law enforcement mission and a federal regulatory agency mission.

10 USC 375 - Restriction on direct participation by military personnel

The Secretary of Defense shall prescribe such
regulations as may be necessary to ensure
that any activity (including the provision of
any equipment or facility or the assignment
or detail of any personnel)
under this chapter does not
include or permit direct
participation by a member of the Army, Navy,
Air Force, or Marine Corps in a search,
seizure, arrest, or other similar activity unl
ess participation in such activity by such
member is otherwise authorized by law.

If state government in California does break away and makes that kind of announced action, the feds will move in with military and totally take over the state capitol and arrest the governor and other officials literally kicking their collective @sses right to the curb, and it will be well deserved,.. I hope they try it, because what they are doing so far is open subversion.

What are they failing to do and fighting to continue doing? Breaking the laws of America by defying federal immigration laws. (because they hate Trump)..
