They were legacy weapons. Hundreds of them were found after the invasion. UN Weapons Inspectors were still finding and destroying these old legacy chemical weapons up until the invasion.

The destruction of mustard and 155mm artillery shells used for mustard gas at the Al Muthana site will resume tomorrow. The destruction process was temporarily halted due to technical problems. When the work was halted, about one-third of 50 liters of mustard had been destroyed. If everything goes well, the destruction work will be completed in four to five days.

UNMOVIC Report

Even the UN teams fully understand that due to the size of the old WMD stocks that there was no suprise that old legacy stocks were going to be found. The Iraq Survey Group found around 500 of these old munitons.

Observations 16. In general, given the large total quantities of chemical munitions produced and filled by Iraq with chemical warfare agents over the period of 10 years, several deployment and recollection campaigns, the dozens of facilities and units involved in the handling of those weapons and the existing gaps in the accounting for the munitions, it is not surprising that some munitions have been found by the coalition forces.

As already indicated in the thread insurgents sometimes didn't realize that the munitions they were using for IEDs were old chemical rounds. Many of the munitions were not marked.
