Man this is a neat story....



"Bronx cabby Mamadou Diallo was looking for a parking spot outside his building when he got a call from his wife that filled him with shock and fury.

She said a stranger had just tried to rape her in their apartment — and was still upstairs.

Diallo grabbed a tire iron and did what most husbands in the same situation would do: He rushed to his wife’s aid and then bludgeoned the pervert."


Everyone's first impression (mine included) is hell yea! He deserved it, and I think he did...but the kicker is by any definition he broke the law. You are not allowed to pursue your attacker to kill them.

For it to be a justifiable homice you must presently be in life threatening danger. Chasing him meant the threat had passed and instead it was a retaliatory killing.

Not saying I disagree, just setting the stage.

But guilty he is, he should have just crippled him and waited for the cops.

I had thought a man had spoken to her in a racist way and the husband killed him for words said and he got away away with murder.

That's not exactly chasing. The husband was headed to his own apartment and confronted the attacker, who seems to have wanted a fight, in a common area of the building in which he lives.

In my state, you are allowed to use whatever force necessary to prevent a violent felony or against a burglar as long as he's still in your home, up to and including deadly force.

Castle Doctrine with no duty to retreat.

If I were on the jury, not guilty no question.

Nice to see a scumbag learn that crime doesn't pay.

Justice was served. If the man broke any laws, they are unjust laws and his jurors clearly took their duties seriously, recognizing that the law should not override common sense or justice.

I appreciate this man and wish he and his wife a full recovery from being victimized by the deceased thug. Hopefully his removal from the gene pool will aid in their healing process.

Couldn't be further from the truth. Why leave it open for a lawsuit from the attacker? Hence why if there is an intruder in your home you shoot to kill not maim.

The reports all say he chased him down which is why he was charged in the first place.
