Uh, no. Any judge can easily argue the guy commited a felony thats known in almost every state as Intimidation. It comes with up to 10 years in prison and a $50,000 fine.

Here in the US we have a similar phenomena, but it has to do with street gangs co-opting team colors for their gang. So if you walk into their turf wearing the wrong team gear, it signals that you belong to a different gang. It has nothing to do with team fanaticism.

I would assume people are going by the photo posted with the Tweet which seems to show a black individual. Now, I know people don't always use their real face in those ... but ...

I'm not so sure about that either. There have been cases where people have made death threats on sites like Facebook and they only received 4 years.

Considering that this was not a threat against the person, but property, he may get off pretty easy.

Here is case in which a man made threats on twitter to shoot schoolchildren and got off on a deferred sentence.

A simple threat to destroy property does not give one the *right* to assault another person *first* unless the danger is imminent and real.

e.g. If someone posts online that they're going to kick your @ss, that does NOT give you the right to seek them out and pound them first. Etc.

Well, his post reeked of violent intent.
He either 1) planned to take her laptop by force to smash it. Or
2)Planned on her being too frightened of a violent confrontation to resist.

They are both violent acts.

Anyway, the point is he should have acted like a bloody grown up and realised he didn't have the right to threaten such stuff against someone simply for voting a different way to him.

Considering the left wing nuts are the ones wanting safe spaces from words and people they don't like the look of, it's high hypocrisy indeed to post stuff like this up in the public domain. How scared must she have felt seeing that?
