Activists in San Angelo, Texas this week were protesting after a local prosecutor’s plea deal sent an alleged rapist home without jail time or requiring him to register as a sex offender.

In a Facebook post last week, Brittany Lynn Rosser explained that she called 911 in January because her boyfriend, 29-year-old Thomas Boden, was drunk and tried to force her to crash the car she was driving, telling her that they both needed to die.

Rosser said that by the time officers showed up at her home, her daughter was screaming, “My butt, my butt!”

“So I laid her down and opened her diaper to find an enormous amount of blood and a clear vaginal tear,” Rosser wrote. “I asked Annabelle what happened and she said, ‘Tom hurt me with his hand.’ I ran outside screaming and crying, pushed past several cops and asked Thomas if he touches my daughter. He didn’t say a word, but had a slight grin on his face.”

Gwad I feel dirty even posting this story, is it possible to have this pos sent to jail or something this is an obvious miscarriage of justice and the judges and prosecutors need to be dealt with harshly also.. fking walked without even the shame of a registered sex offender??.. I won't say anymore out fear of violating ATS rules and Regs.

Apparently the voters are unaware that they have a problem. Perhaps women and children issues are not important.

What? This is a travesty of justice!!! This reporter is absolutely right. Considering how many non-violent drug offenders are serving long and even life terms, this guy gets off with what amounts to a slap on the wrist!! He's not even required to register as a sex offender!!!

If this was my little girl, I would be this guy's worst nightmare! What the hell is wrong with this prosecutor? Maybe he's a child molester and sided with this sick b*stard!

Women... PLEASE quit bringing your "boyfriends" around your children. PLEASE.

This happens far too often. Many walk, some don't. Love your children enough to not bring every Tom, Dick, and Harry around them. I understand sometimes things happen with folks we never imagined would do things like this but it happens all too frequently because mom just wants her boyfriend around.

This makes me sick and sad and angry.

meh, read the story. The headline is misleading. He never admitted to doing it, he excepted the plea - that's where they get admitted guilt. Basically the Prosecuters were afraid with no witnesses he may get off with no charges. We have this thing called reasonable doubt in the US... Maybe the mother shouldn't have allowed the PoS to be around her children in the first place. He is on 10 years probation and has to register as a sex offender.

ohh crap i missread, he will NOT be registered as a sex offender. That seems like a real loss. That means the prosecutor thought he had very little chance of winning. Sad day for all to be sure.

That makes no sense to me. If they have a low reporting rate, how would they know there are high incidents of sexual assault cases? They can't know of a higher # than the low #'s being reported. Sounds like a cop out excuse / reason for not doing their jobs properly. If they had so much evidence [DNA as was mentioned in the story] there would have been no need for the child to testify. The rapist had all the rights while the rights of the child were stripped away.

On a personal note, I know someone who had consensual sex with a minor [he was 19 & she was 15]. 4 months was all it took [under the law] to make this act illegal. There is much more to the story however. The young man who was charged was mentally challenged, had good attorneys, and still got two yrs. house arrest. .. and this was consensual. Still, much more to the story--just making a point here.

The little girl in this story has no voice-literally no voice-none. Her mother should have hired someone to fight for the rights of her child--which should have been the state fighting for her, but things don't always work out in the way they should. The little one will learn young that life isn't fair. He stole an awful lot from her.

I'm sure that the locals or family members will take care of justice. That's a shame and I have two reasons why:

1. Because its ridiculous that someone can get away with this, with a plea deal of all things.

2. Said family members or locals could get in trouble with the law for giving their version of justice to this man no matter how much he deserves it.

My stomach wrenched trying to get through the brief blurb in the OP. If he were to be sent to jail he'd never get out. It's one of those rare occasions I respect hardened criminals.

He does not have to report as a sex offender as part of the plea.

A few questions.

Is the prison service in this area privately run?

Do privately-run prisons use sex-offenders amongst the slave-gangs they rent out to other private organisations? Or are sex-offenders excluded from this 'activity' in the interests of their safety?

If sex-offenders are excluded from this type of prison slave work then they are an expensive burden on that private interest. Would a for-profit prison try to wriggle out of accepting prisoners who, for whatever reason, can't work?

Maybe the private prisons in that area have a quota and don't have any 'taxpayer-funded-cells-for-unprofitable-convicts' vacant just yet? Is this why some convicts are jailed and some are not? Who knows?

Allowing private interest to run for-profit prisons will mean you end up with two prison services, a private one where inmates are able to be put to work and are therefore an asset, and a second one where 'un-profitable' inmates who can't be integrated and/or can't work are jailed at cost to taxpayers. I can see it coming, if it hasn't already.

Privatise profit/gain and socialise cost/burden. So what's new.

They get statistics from other sources, I would assume. Like rape crisis centers and families. It is a societal problem of shame and distrust in the justice system. Most women know of cases of unreported rapes.

You are right i correct my post. That means it really was a thin case. Come on people if a prosecutor thought he could convict the guy he would hang him out to dry. Its a no brainer. The case must have been thin and the circumstances surrounding it (like the mother) must have been pretty bad. Does know one watch Law and Order? He has to be able to get a conviction or the guy walks. We all agree the guys a PoS, you know how many PoS are walking the earth? A bunch. I think the mother bears some of the guilt here for bringing him into her house. I'm sure she is a real gem too.

Yea, ten years probation and no sex offender registry, plus a no contact order, is a slap on the wrist.

To all of you wailing for the judge and prosecutor to be hung, I would ask what your opinion of "not guilty, so zero years of anything" sounds in comparison to what he actually got. Better? Worse?

Yea, it sucks. Those of you who are a parents? Why don't you imagine your kid as a two year old trying to testify in court. See how you feel about that. Now add to that there's not one adult witness to it. So your little two year old is testifying on their own.

It's not what you know, it's what you can prove. For better or worse.
