It says the government will not recommend a sentence of more than 12½ in prison, while Fogle will not ask for a sentence of less than five years in prison.

The plea agreement says Fogle traveled to New York and paid for sex with at least two minors between about 2010 and 2013 at the Plaza Hotel and the Ritz Carlton Hotel. The victims were 16 and 17 years old.
Fogle repeatedly asked one of the minor victims and "several others" to provide him with access to minors as young as 14 years for sex. He told one of the victims, "The younger the girl, the better." He offered "numerous prostitutes" with whom he had sex a finder's fee for access to minors he could pay for sex.
The plea agreement says that on "multiple occasions" between about 2011 and 2015 Fogle received child pornography from Russell C. Taylor, the former executive director of his charity, The Jared Foundation. The unidentified victims in the photos and videos were as young as "approximately six years of age."

Fogle first came to media attention in April 1999, through an article written in the Indiana Daily Student by a former dormmate about Fogle's weight loss.[1] Fogle was later featured in a Men's Health magazine article, "Stupid Diets. . . that Work!"[2] According to the article, Fogle had become obese by eating junk food and not exercising. Switching to eating at Subway, he changed his eating habits there to include healthier choices and smaller portions free of fattening condiments such as mayonnaise, which was followed by his significant weight loss. A Chicago-area Subway franchisee took the idea to Subway's Chicago advertising agency.[1]

Part of the case involves images Fogle received from Russell Taylor, the head of Fogle’s foundation. According to the complaint, Taylor sent Fogle photos of and videos from hidden cameras in Taylor’s house, featuring children as young as 6.
